🚨 **𝗕𝗶𝗴 𝗖𝗵𝗮𝗻𝗴𝗲 𝘁𝗼 𝘁𝗵𝗲 𝗧𝗿𝗮𝗶𝗻𝗶𝗻𝗴 𝗩𝗶𝘀𝗮 (𝗦𝘂𝗯𝗰𝗹𝗮𝘀𝘀 𝟰𝟬𝟳) – 𝗦𝘁𝗮𝗿𝘁𝗶𝗻𝗴 𝟭𝟭 𝗠𝗮𝗿𝗰𝗵 𝟮𝟬𝟮𝟲 🇦🇺

Planning to apply for a **Training Visa (Subclass 407)**?
Important new rules are coming into effect that will change **how and when you can lodge your visa application.**

📌 **𝗪𝗵𝗮𝘁’𝘀 𝗰𝗵𝗮𝗻𝗴𝗶𝗻𝗴?**

From **11 March 2026**, you will only be able to lodge a **valid Subclass 407 visa application if BOTH of the following are already approved:**

✅ **Approved Temporary Activities Sponsor**
✅ **Approved nomination for the occupational training program** *(unless the sponsor is a Commonwealth agency)*

Your visa application must also **identify the approved nomination**.

⏪ **𝗕𝗲𝗳𝗼𝗿𝗲 𝘁𝗵𝗶𝘀 𝗰𝗵𝗮𝗻𝗴𝗲**

Applicants could lodge the **sponsor application, nomination and visa application at the same time**, and approvals only needed to be granted **before the visa decision**.

▶️ **𝗨𝗻𝗱𝗲𝗿 𝘁𝗵𝗲 𝗻𝗲𝘄 𝗿𝘂𝗹𝗲𝘀**

The **sponsor approval and training nomination must already be approved before you can lodge the visa application.**

🎯 **𝗪𝗵𝘆 𝗶𝘀 𝘁𝗵𝗲 𝗴𝗼𝘃𝗲𝗿𝗻𝗺𝗲𝗻𝘁 𝗺𝗮𝗸𝗶𝗻𝗴 𝘁𝗵𝗶𝘀 𝗰𝗵𝗮𝗻𝗴𝗲?**

The Department of Home Affairs introduced these amendments to:

• strengthen the **integrity of the 407 visa program**
• ensure training programs are **genuine and structured**
• prevent misuse of the visa to **extend stays in Australia**
• reduce attempts to **bypass skilled migration pathways**

📊 The change follows a **significant increase in onshore 407 visa applications since mid-2024**, which has also led to **longer processing times**.

⚠️ **𝗘𝘅𝗰𝗲𝗽𝘁𝗶𝗼𝗻**

**Commonwealth agencies remain exempt** from the requirement to lodge a training nomination.

🎓 **Student Visa ART Update – Please Read** 📢

We currently have **some clients with matters before the ART**, so here is a clear and reassuring update regarding recent legislative changes.

# # # What is the ART?

⚖️ The **Administrative Review Tribunal (ART)** is the independent body that reviews certain visa refusal and cancellation decisions made by the Department of Home Affairs.
If a visa is refused, eligible applicants can apply to the ART for a merits review of that decision.

# # # ✅ Nothing has changed yet

The new legislation received Royal Assent on 9 February 2026, but it has **NOT commenced**.
Current ART review processes remain exactly the same.

⏳ **When could it start?**
The changes will commence on a future date set by the government (by Proclamation), or automatically within **6 months of Royal Assent** if not commenced earlier.

📄 Certain **student visa refusals** may be decided “on the papers”
✍️ Meaning decisions based entirely on written submissions
❌ No oral hearing in some temporary visa matters

Important clarifications:
🔹 Applies to student visas and certain temporary visas only
🔹 Does **NOT** apply to permanent visas
🔹 Does **NOT** apply to protection visas
