The new Administrative Review Tribunal (ART) review process for prescribed temporary visa decisions is now in operation.

For eligible temporary visa review applications, the ART may now determine a matter without conducting an oral hearing.

Instead:

β€’ Applicants may receive an invitation under section 367F of the Migration Act 1958.
β€’ All evidence, explanations and submissions must be provided in writing.
β€’ The Tribunal may make its decision solely on the documents before it.

πŸ“Œ Practical Implications for Applicants and RMAs

βœ… Front-load all supporting evidence from the outset.

βœ… Prepare comprehensive written submissions addressing every relevant issue.

βœ… Do not assume there will be an opportunity to clarify matters at a hearing.

βœ… Ensure all documents are lodged within the timeframe specified by the ART.

⚠️ Failure to respond to a section 367F invitation may result in dismissal of the review application. While reinstatement provisions may be available in certain circumstances, applicants should not rely on these provisions.

Under the Administrative Review Tribunal Amendment (2026 Measures No. 1) Rules 2026, ART Registrars and authorised staff may:

β€’ Issue invitations under section 367F.

Importantly, substantive review decisions continue to be made by ART Members.
