Can I get a 482 visa if my degree doesn't match my job? This is a question we get asked a lot and the answer is: it's possible!

We've helped many clients whose qualifications didn't directly match their nominated occupation. In some cases, previous work experience can be used to obtain relevant certificates through Recognition of Prior Learning (RPL).

However, keep in mind that depending on your nominated occupation, you may still need a positive skills assessment to be eligible for your 482 visa.

We've recently seen many social media posts claiming that Brisbane, Melbourne, and Sydney-based logistics companies can easily sponsor truck drivers through Company Specific Labour Agreements. Let us tell you the reality and the harsh truth.

At Visa Empire, we've been handling Company Specific Labour Agreements since 2021. When it comes to dealing with the Transport Workers Union, they are not very supportive. People assume that if a company is based in a metropolitan area, sponsoring a truck driver is simple. That's not the case.

Before pursuing this pathway, always talk to someone experienced in this field. Understand your obligations, the criteria the union expects from you, and most importantly, the realistic timeline.

Here's the truth: we have major logistics companies based in Melbourne and Sydney with Company Specific Labour Agreements currently in the pipeline for 18 to 24 months, with no response yet.

The union itself takes a long time to respond. And even if the union doesn't respond, the agreement can still be lodged, but from there, it's entirely up to the Department, and there is no definite processing timeframe for these applications.

For comparison, in the health industry, we typically see outcomes within 8 to 9 months. But for logistics companies, even the Migration Institute of Australia is currently advocating for some of our applications, trying to escalate matters with the Department of Home Affairs, and it's not an easy process.

Don't fall into the trap of trusting social media posts from people who have never actually worked in this space. Your future shouldn't be based on guesswork about a pathway you don't fully understand the eligibility criteria for.

If salary is a problem for your 482 visa, don't worry, it's not the end of the world!

Here's a solution many people don't know about: if you go to a regional area where a Labour Agreement is in place, some Labour Agreements offer salary concessions specifically for Chefs and Cooks.

What this means is that through the operation of the Labour Agreement, an employer can sponsor you at 10% less than the standard minimum salary threshold. So instead of paying almost $80,000, the employer can pay around $71,000-$72,000 plus superannuation and still meet the sponsorship salary requirement!
Keep in mind, different Labour Agreements have different rules, and this concession is generally available in regional areas only.

In metropolitan areas like Sydney, Melbourne, and Brisbane, there are no such concessions, unless a company has a specific Labour Agreement of its own in place.

Did you know that Forklift Driver is usually NOT an eligible occupation under the standard 482 visa? If you check the occupation list, it's marked with a cross .

But here's the good news, under a Labour Agreement, specifically DAMA (Designated Area Migration Agreement), Forklift Driver CAN be sponsored! DAMAs offer concessions on age, English requirements, and more, making it possible to apply even when the standard visa pathway doesn't allow it.

It's important to know that every DAMA is different, requirements vary from region to region. If you do get sponsorship, you'll be nominated under that specific agreement.

The main requirements generally include:
Minimum 1 year of relevant work experience
A valid skills assessment
Vocational English

Everyone's talking about Expressions of Interest and which states are open, and yes, we cover that too. But there's a whole other world happening in the Federal Circuit Court that deserves attention. Right now, there are real breakthroughs happening in migration law.

We're currently working on a case where a visa was refused, and the core of our argument is this: the tribunal member drew an inference, made an assumption, even though the client had presented evidence to the contrary.

In this particular case, it was about a relationship. The department applied a "one size fits all" standard for what a relationship should look like and what documents should prove it. Based on recent case law, we're arguing that's simply not how it works. There is no standard template for relationships, everything needs to be assessed as a whole.

Think about it: how can a tribunal member decide what's "normal" and make assumptions, when the applicant already provided evidence showing otherwise?

If your visa has been refused based on assumptions rather than the full picture of your evidence, you may have grounds to challenge that decision.

The last invitation round for the 189 visa was a couple of months ago, and it's confirmed there will be another round by 30th September 2026. Looking at the recent occupation list, a lot of trade occupations were invited, some at fairly low points. Naturally, many people are now asking: should I study a trade?
Here's the reality check: what's happening now is not a guaranteed predictor of what will happen in the future. It's a good indication, but nothing is set in stone. So if you've already completed an IT occupation, nursing, or any other qualification, finish it and lodge your Expression of Interest. You never know, you might still get invited.
Now, about trades, here's how it actually works. If you're on a 485 visa or a student visa, the fastest path is two years (485 visa, via the 1-year fast track course) or three years (student visa). But that's not the end of it, you must also work in the field for 12 months under the Job Ready Programme before you're even eligible for a skills assessment.

So when people recommend "just study a trade" without explaining this full timeline, it's misleading. This isn't a one-year fix, it's a two-year minimum commitment. And basing that decision purely on what invitation rounds look like today isn't a strong predictor of what the landscape will be in two years.

Should you do it? By all means, trades can be a great pathway. But make sure you're looking at all your options and strategies before committing.
