πŸ“’ NEW POINTS TEST PROPOSED TO COMMENCE IN MARCH 2027

Australia’s skilled migration system is expected to undergo significant reform, with a new Points Test proposed to commence in March 2027.

Key features under consideration include:

πŸ”Ή Greater recognition of educational qualifications
πŸ”Ή Increased weighting for higher-skilled occupations
πŸ”Ή Stronger emphasis on age in points allocation
πŸ”Ή A focus on attracting migrants who support Australia’s long-term workforce and economic needs

Current and prospective skilled migrants may benefit from understanding these proposed changes when planning their education, career, and migration pathways.

As more details become available, applicants should monitor official announcements and seek professional advice based on their individual circumstances.

πŸ’¬ What are your thoughts on the proposed changes? Will a greater focus on education, skills, and age strengthen Australia’s skilled migration program?

🚨 189 OCCUPATION CEILINGS RELEASED 🚨
Is Your Occupation Positioned for an Invitation in 2026–27?

The Department of Home Affairs has published the occupation ceilings for the Skilled Independent (Subclass 189) visa program. As we approach the 2026–27 program year commencing on 1 July 2026, it is important to understand how these ceilings may influence your migration strategy.

πŸ” What is an Occupation Ceiling?

An occupation ceiling is the maximum number of invitations that can be issued to applicants in a particular occupation during a program year. The purpose is to maintain a balanced skilled migration program across a broad range of occupations.

πŸ’‘ Why Does It Matter?

βœ… Indicates the level of competition within your occupation

βœ… Provides insight into potential invitation opportunities

βœ… Assists with strategic planning for your migration pathway

βœ… Helps identify alternative options such as Subclass 190 or Subclass 491 visas where appropriate

⚠️ Important Considerations

πŸ”Ή The 2025–26 Subclass 189 allocation has effectively been exhausted. For many applicants, the next meaningful opportunity for invitations will be in the 2026–27 program year.

πŸ”Ή Occupation ceilings are only one part of the equation. Invitations are still issued based on SkillSelect rankings, points score, and invitation round settings.

πŸ”Ή Even where places remain available under an occupation ceiling, higher-ranked applicants may receive invitations before others in the same occupation.

πŸ“Œ Now is the ideal time to review your EOI, maximise your points, confirm your occupation pathway, and prepare for the upcoming program year.

🚨 SOUTH AUSTRALIA SKILLED MIGRATION UPDATE 🚨

πŸ“’ Registrations of Interest (ROIs) for South Australian State Nomination will close at 9:00 AM (ACST) on 2 June 2026 for the 2025–26 program year.

⏳ If you are considering South Australia for state nomination, ensure your ROI is submitted before the closing date.

Key points:
βœ… ROI submissions close on 2 June 2026
βœ… The last formal invitation round was held on 21 May 2026
βœ… South Australia may continue limited invitation activity to optimise remaining nomination places
βœ… New ROIs will reopen when the 2026–27 program commences
βœ… Applications for nomination can still be lodged and assessed

⚠️ With limited nomination places remaining, not all eligible applicants may receive nomination during the current program year.

If you would like an assessment of your eligibility for South Australian state nomination or other skilled migration pathways, contact us for personalised advice.

βš–οΈ ART "ON THE PAPERS" REVIEW PROCESS NOW COMMENCED

πŸ“… Effective 1 JUNE 2026

The new Administrative Review Tribunal (ART) review process for prescribed temporary visa decisions is now in operation.

πŸ” What has changed?

For eligible temporary visa review applications, the ART may now determine a matter without conducting an oral hearing.

Instead:

β€’ Applicants may receive an invitation under section 367F of the Migration Act 1958.
β€’ All evidence, explanations and submissions must be provided in writing.
β€’ The Tribunal may make its decision solely on the documents before it.

πŸ“Œ Practical Implications for Applicants and RMAs

βœ… Front-load all supporting evidence from the outset.

βœ… Prepare comprehensive written submissions addressing every relevant issue.

βœ… Do not assume there will be an opportunity to clarify matters at a hearing.

βœ… Ensure all documents are lodged within the timeframe specified by the ART.

⚠️ Failure to respond to a section 367F invitation may result in dismissal of the review application. While reinstatement provisions may be available in certain circumstances, applicants should not rely on these provisions.

πŸ“‹ ART Registrar Powers

Under the Administrative Review Tribunal Amendment (2026 Measures No. 1) Rules 2026, ART Registrars and authorized staff may:

β€’ Issue invitations under section 367F.
β€’ Manage procedural requirements.
β€’ Dismiss applications where no response is received.

Importantly, substantive review decisions continue to be made by ART Members.

πŸ’‘ Key Message:
The success of many ART review applications will now depend heavily on the quality of the written evidence and submissions provided. Proper preparation at the commencement of the review process is more important than ever.
