Student visa refused? New rules change how the ART reviews your case β effective 1 June 2026.
Most refusal reviews will now be decided on the papers (written submissions only β no hearing). The ART will invite you to submit evidence on your enrolment before deciding.
Two key deadlines apply:
π 28 days to respond to an s367F invitation β missing this means your review is dismissed.
π 14 days for s367G β late replies are still considered if no decision has been made yet.
Does not apply if the refusal involved character, fraud, health, debt or Special Return Criteria.
Deadlines are strict. Get advice before you respond to any ART invitation.

Here's how the numbers shifted compared to last year:

Employer-Sponsored visas β UP by 14,040 places (44,000 β 58,040)
β
Skilled Independent (Subclass 189) β UP by 4,190 places (16,900 β 21,090)
β
State/Territory Nominated (Subclass 190) β UP by 2,500 places (33,000 β 35,500)
β Regional (Subclass 491) β CUT by 18,890 places (33,000 β 14,110)
β Talent and Innovation β CUT by 1,800 places (5,300 β 3,500)
The total skilled program stays roughly the same at 132,240 β which means the government has shifted places away from regional and talent visas and poured them into employer-sponsored and independent pathways.
What this means for you:
π If you have an employer willing to sponsor you β 2026β27 is the best year in recent memory to pursue it.
π If you were banking on a 491 regional nomination β competition just got significantly harder. Don't wait.
π If you're points-tested β the 189 and 190 pools are growing, which is good news.

The Department of Home Affairs has just released the planning levels for the 2026β27 permanent Migration Programme β and there is very good news if you are already living in Australia.
π The Numbers:
β’ 185,000 total permanent places (held flat for the 3rd year)
β’ 132,240 for skilled migrants (71%)
β’ 52,460 for families
β’ 129,590 places (70%) reserved for people ALREADY IN AUSTRALIA
β’ Only 55,110 places for offshore applicants
π What This Means For You:
π’ On a 482, 485, student, or bridging visa? The Government is prioritising YOU for permanent residency. Now is the time to act.
π’ Applying for a partner visa? The onshore 820/801 pathway is now structurally favoured. If your partner is in Australia, apply onshore.
π’ Employer sponsoring someone? The minimum salary for a 482 Core Skills nomination rises from $76,515 to $79,499 on 1 July 2026. Lodge before that date if your salary offer is close to the limit.
π’ Have an EOI in SkillSelect? The points test is being reformed. If you currently meet the invitation threshold, get moving now β before the scoring criteria change.
π’ Working in a trade? The Government is investing $85.2 million to speed up skills assessments through Trades Recognition Australia.
