Legal Tip of the Week.

Sending promotional messages via WhatsApp is legally regarded as direct marketing.

Under POPIA, businesses should generally:
✔️ Obtain the recipient's prior consent before sending marketing messages.
✔️ Clearly identify themselves as the sender.
✔️ Provide an easy way for recipients to opt out of future communications.

A common mistake is adding customers or potential clients to WhatsApp broadcast lists without first obtaining their permission. Just because someone gave you their phone number does not automatically mean they agreed to receive marketing messages.

Ignoring these requirements can expose your business to:
⚠️ Complaints to the Information Regulator
⚠️ Reputational damage
⚠️ Regulatory enforcement and, where applicable, administrative fines

So, if you're using WhatsApp to promote your products or services, make sure you have a lawful basis to do so, and always make it easy for people to unsubscribe.

For me, compliance isn't just a legal requirement, it's a way of building trust with your customers by respecting their privacy.

When parents separate, it's easy for conflict to become the focus. But the law reminds us of something far more important: the child comes first.

Legal Tip of the Week

📂 Keep copies of your most important legal documents in a safe place.

Important documents such as your:
- ID or passport
- Marriage certificate
- Will
- Title deed
- Birth certificates
- Trust or company documents (where applicable)

should be stored securely and be easily accessible when you need them.

Having organised records can save you significant time, stress, and money. It can also help prevent unnecessary delays and costly legal disputes if a document is lost, damaged, or urgently required.

💡 Bonus tip: Keep both physical copies in a secure location and encrypted digital copies stored in a trusted cloud service or secure external drive.

A little organisation today can save you a great deal of frustration tomorrow.

Think before you click "I Agree."

Almost every website, app, or online service has Terms and Conditions. When you click "Accept", "I Agree", or a similar button, you're not just moving on to the next page, you're entering into a legally binding contract.

This is known as clickwrap consent.

A common misconception is that you're only bound by the terms if you've actually read them. In reality, by clicking "I Agree", you're generally accepting all of the terms and conditions, including the fine print.

That means a company may be able to enforce those terms against you, even if you never took the time to read them.

Of course, there are limits. A company cannot enforce terms that are unlawful, unfair, or contrary to public policy, and in South Africa, certain consumer protections under the Consumer Protection Act may also apply. However, simply saying "I didn't read it" is usually not a valid legal defence.

👉The takeaway?

Before you click "I Agree", take a few minutes to scan the terms, especially the clauses dealing with:
• Cancellation and refunds
• Automatic renewals or subscriptions
• Limitation of liability
• Privacy and the use of your personal information
• Dispute resolution and governing law

The 2 biggest PAIA compliance misconceptions I hear all the time...

With the 30 June PAIA Annual Report deadline fast approaching, now is the time to make sure your organisation is compliant.

❌ Myth #1: "We're a small business, so PAIA doesn't apply to us."

Not quite.

Many organisations assume that because they're a small business, they have no obligations under PAIA or POPIA. If your organisation processes personal information, you should ensure your Information Officer is registered with the Information Regulator and that you're meeting your compliance obligations.

❌ Myth #2: "We didn't receive any PAIA requests this year, so we don't need to submit an annual report."

Incorrect.

Even if your organisation received zero PAIA requests during the reporting period, you are generally still required to submit a nil report to the Information Regulator. No requests does not mean no reporting.

⏰ The 30 June deadline is almost here. Don't leave your compliance until the last minute.
