There are growing fears of a return to civil war in Ethiopia following renewed fighting between Prime Minister Abiy Ahmed's army and fighters belonging to the formation of a new rebel alliance aimed at overthrowing the government. Tigray residents, who have been trying to recover from a brutal two-year war that ended in 2022, fear a return to full-scale conflict, with reports of panic buying, and now internet and call services have been disrupted.

Kenyan President William Ruto has renewed calls for sweeping reforms to the UN Security Council, urging world leaders to grant Africa permanent representation and overhaul the global financial system to better serve developing economies. Addressing the UN General Assembly in New York, Ruto said Africa's continued exclusion from the Security Council's permanent membership undermines the credibility and legitimacy of the international rules-based order.

The former head of the Gambian paramilitary unit known as the ‘Junglers’ has appeared in a military court to face charges of desertion. Sanna Manjang is accused of deserting the armed forces when the lieutenant colonel fled the country in 2017 after the end of the 20-year rule of President Yahya Jammeh. The case marks another official bid at accountability for killings which happened when Jammeh was in power, after a murder case against Manjang was dropped in July.

RESIDUARY HEIR ALLOWED TO INTERVENE IN CLAIM AGAINST ESTATE AND BID TO DECLARE ESTATE’S ONLY ASSET SPECIALLY EXECUTABLE

In Capelluto NO v Vavatzanidis NO and Another the Western Cape High Court held that a residuary heir may intervene where a creditor's claim threatens to pre-empt the statutory claims process and the estate's only asset.

The executrix of Mark Hammerson's estate sued the executor of Minette Hammerson's estate for R12 million and sought an order declaring the estate's only substantial asset, a Bantry Bay property, specially executable. A 50 per cent residuary heir applied under Uniform Rule 12 to intervene, which requires a direct and substantial interest (Amalgamated Engineering Union v Minister of Labour). The court accepted that an executor ordinarily represents the estate and that an heir's financial expectation does not confer standing (Gross v Pentz). However, the executor had invoked s 32 of the Administration of Estates Act to require substantiation of the claim, and that process remained incomplete. Section 32(2) allows an heir to question the claimant, and s 35(7) lets any interested person object to the liquidation and distribution account. Final judgment and ex*****on would pre-empt those statutory rights, not merely reduce an inheritance. In these exceptional circumstances, the heir showed a direct and substantial interest and, following SA Riding for the Disabled Association v Regional Land Claims Commissioner (CC), leave ought to be granted. Her personal knowledge of the family history supported intervention.

The residuary heir was granted leave to intervene as the third respondent in the main application brought by the executrix against the executor.
