This post defines tribal sovereignty through history, court decisions, and legislation, as a background for attorneys learning to understand Indigenous and tribal rights. Tribal sovereignty today exists in mainly three realms: 1) tribes having a say in how the government or non-tribal members interact with them or treat them, 2) criminal jurisdiction, 3) and civil jurisdiction.
