The total number of petitions filed to Tax Court in a typical year is between 23,000 to 26,000 cases (U.S. Tax Court Press Release 07/23/2021). In 2021, Tax Court actually received over 33,000 petitions filings (U.S. Tax Court Press Release 12/09/2021). And IRS Chief Counsel office is adding 200 attorneys to combat abusive tax (IR-2022-17 01/21/2022).

These are all indicators that the tax litigation wave will continue to surge in the coming years!

Tax Court, however, does not recognize IRS Form 2848 Powers of Attorney for purposes of communications with the Court, making filings to the Court, or for purposes of representing taxpayers in litigation before the Court. Petition signing or entry of appearance filed by a person not admitted to practice before the Court is not effective until that person is eligible to be admitted to practice before the Court. (Tax Court Rules of Practice and Procedure, Rule 24(a)(3))

A non-attorney tax professional can be admitted to practice before Tax Court upon satisfying to the Court that they possess requisite qualifications to provide competent representation. (Tax Court Rules of Practice and Procedure, Rule 200(a)(3))

Competency requires knowledge of proper advisement, case management including proper filings, rules of the court, evidentiary and ethics rules. U.S. Tax Court administers the non-attorney examination every two years.
