Well, there you have it. The courts have spoken in the case of "Silencer Shop Foundation v. ATF". Silencer Shop
Please note:
In these 27 states, there are no independent state-level NFA registration laws. Under the federal injunction, qualifying buyers can purchase suppressors over-the-counter like a standard fi***rm by filling out an ATF Form 4473 and passing a standard NICS background check:
Alabama, Arizona, Arkansas, Florida, Idaho, Indiana, Iowa, Kansas,, Kentucky, Louisiana, Maine, Maryland, Minnesota, Missouri, Nebraska, New Hampshire, New Mexico, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, Vermont, Virginia, West Virginia, Wyoming
In these 15 states, suppressors are entirely legal to own, but local state laws explicitly mandate the NFA Form 4 process. Buyers in these locations must still submit fingerprints, photos, and wait for electronic Form 4 approval:
Alaska, Colorado, Connecticut, Georgia, Michigan, Mississippi, Montana, Nevada, North Carolina, North Dakota, Ohio, Oregon, Pennsylvania, Washington, Wisconsin
In these 9 states, civilian ownership and possession of suppressors remain strictly prohibited by state law, completely independent of any federal rulings:
California, Delaware, Hawaii, Illinois, Massachusetts, New Jersey, New York, Rhode Island, Washington, D.C.
