DOJ Won’t Appeal NFA Ruling on Suppressors and SBRs
The Department of Justice says it will not appeal a federal court ruling that blocked key National Fi****ms Act rules for certain suppressors, short-barreled ri**es and short-barreled sh****ns.
The ruling came after Congress lowered the NFA’s federal making and transfer tax to $0 for those items.
A federal judge said that without the tax, the government could no longer rely on its taxing power to support the registration and approval rules being challenged.
What does this mean for everyday gun owners?
This does NOT mean the NFA is gone nationwide.
The court order currently protects the people and groups involved in the lawsuit and, in some cases, their current and future members and customers.
That means ATF and DOJ cannot enforce the challenged NFA rules against the people covered by the court order.
For gun owners who are not covered by the ruling, current federal NFA rules may still apply.
Because DOJ will not appeal, this ruling will stay in place for the people it covers. But it does not mean every gun owner in the country is now exempt from NFA requirements.
