You may have your name on the deed.
You may have paid the mortgage for years.
You may have built hundreds of thousands of dollars in equity.
But that does not mean there are no other legal interests attached to the property.
Your home can still be affected by:
- Mortgages and deeds of trust
- Property-tax liens
- HOA restrictions
- Easements
- Utility rights
- Zoning and land-use rules
- Judgments and creditor liens
- Government assessments
- Recorded restrictions
- Other title claims
That is why it is important to understand the difference between possession, title, equity, control, and ownership rights.
A deed is important, but it does not necessarily tell the entire story.
The better questions are:
What exactly does your deed convey?
How are you vested?
What liens or encumbrances are attached to the property?
What easements or restrictions affect your land?
Who else may have legally enforceable rights connected to the property?
What happens if taxes are not paid, a lien is filed, or another claim is asserted?
Most homeowners never seriously examine these questions until something goes wrong.
That is the problem.
Your home may be the largest asset you ever own. You should understand the paperwork underneath it.
Know your deed.
Know your title.
Know your equity.
Know the claims.
Know your rights.
