ACO Misconception “Animal Control Can Make Owners Surrender Their Pets.”

Animal Control cannot force an owner to surrender an animal unless the legal threshold for cruelty or danger is met.
Owners have rights under the law even when their choices frustrate rescuers.

Seizure requires:

Statutory authority

Evidence

Documentation

Legal thresholds

Due process

Sometimes a judge’s order
