Are Tasers & Pepper Spray Legal in New Jersey?

Yes — both are legal in New Jersey, but for self-defense purposes only. Since a 2017 federal court ruling struck down the state's former ban, adults 18 and older with no disqualifying criminal history may legally purchase and possess a Taser or stun gun in New Jersey, with no permit or background check required at the point of sale. Pepper spray is legal under N.J.S.A. 2C:39-6(i) for adults 18 and older with no disqualifying convictions, provided the canister is pocket-sized and holds no more than three-quarters of an ounce (0.75 oz) of active ingredient.
