𝐍𝐄𝐖𝐒: SSC Sen. on WAM questions opt-out mech IRR, says it lacked student representation, transparency

Supreme Student Council Senator on Ways and Means Angelo Mallari took to social media to express his concerns over the crafted implementing rules and regulations (IRR) of the opt-out mechanism of Tarlac State University (TSU).

In a Facebook post, Mallari highlighted the lack of student involvement in crafting the IRR. He quoted the former SSC president, who said the student regent was only involved in the final stage of the crafting process, with no ability to make revisions.

“Diba kapag gumagawa ang TSU ng mga ganitong hakbang, bumubuo sila ng committee at isinasama ako? Pero ang nangyari, parang babasahin ko na lang. Ngayon, nung na-raise ko na yan, edi isinama ang student regent. Sinama nga ako, pero parang ang nangyari, babasahin ko na lang ulit. Tapos sinabi nila na hindi na pwedeng mag-revise, kasi for approval na nga daw.”

Mallari also stated that the IRR lacked clarity on payment procedures and other considerations like promissory notes for students who could not pay immediately. He said that the only clear thing was that students unable to make an initial payment would be removed from the system and would be unable to encode their grades.

Moreover, Mallari also pointed out the lack of transparency, saying the IRR was never published. While there were posts regarding the implementation of the opt-out mechanism, detailed explanations on how long it will continue to run were not provided.

With this, Mallari claimed that the opt-out mechanism appears to have been implemented to accommodate students recommended by politicians.

“Malinaw na ginawa ito upang maipasok ang mga estudyanteng pinakiusap ng ilang politiko sa pamamagitan ng pagpopondo sa kanila bilang opt-out students,” he wrote.

He added that the crafting of the IRR was rushed as no committee was created, and the student regent or any student representation was not included in the process.

“Malinaw rin na minadali ang crafting, walang committee na binuo, at hindi isinama man lang ang student regent o kahit sinong kinatawan na sana'y magpapaliwanag kung bakit ito nabuo nang walang anumang konsultasyon,” he remarked.

Ang pagbabanta ng suspensyon sa tatlong mag-aaral ng Tarlac State University (TSU) matapos ‘di umanong sumali sa isang mobilisasyon ay malinaw na isang uri ng pagsupil sa karapatan ng sangkaestudyantehan. Ang nasabing mobilisasyon ay naganap noong March 8 sa pagdiriwang ng International Women’s Day sa Plaza Miranda, Angeles City, Pampanga.

Ayon sa sulat na kanilang natanggap noong March 16 mula sa Student Discipline Unit (SDU) ng Student Affair and Service (SAS) ng institusyon, nilabag ng tatlong mag-aaral na ‘di umano ay kumakatawan sa Tindig-TSU, isang partidong politikal sa unibersidad, ang panuntunan ng pamantasan. Maaaring patawan ng pito hanggang 15 na araw na suspension ang tatlong mag-aaral.
Ilan lamang sa mga paratang na paglabag na ito ay pagdaraos ng isang kaganapan ng hindi akreditadong organisasyon at pangunguna o pagsali sa mga aktibidad mula sa isang hindi akreditadong organisasyon. Bagama’t inamin ng Tindig-TSU na hindi sila kinikilala bilang isang akreditadong organisasyon sa unibersidad para sa kasalukuyang akademikong taon, ang SDU ng SAS office ay walang karapatang sugpuin ang anumang anyo ng pananalita at pagpapahayag mula sa organisasyon at sino man sa kanilang mga mag-aaral.

Ang panawagan ng mga mag-aaral sa institusyon ay patuloy na itaguyod ang kanilang karapatan sa pagpapahayag batay na rin sa ilalim ng Bill of Rights ng 1987 Constitution of the Republic of the Philippines.

Kaisa ang Kabataan Partylist Tarlac sa panawagan na ito. Hindi kailanman dapat sinusupil ang karapatan ng mga kabataan na magsalita at magpahayag ng kanilang opinyon at paniniwala. Ang paggamit ng boses ng kabataan upang labanan ang katiwalian at pakikiisa sa laban ng mga masang api ay isa sa kanilang mga karapatan. Walang sino at ano mang institusyon ang maaaring magpatahimik sa kanilang mga pinaglalaban. Ipagtanggol ang demokratikong karapatan ng mga mag-aaral!

Binantaan ng suspensyon ng Tarlac State University (TSU) ang 3 sa kanilang mga mag-aaral matapos makiisa ‘di umano ang mga ito sa panrehiyunal na pagkilos hinggil sa pagdiriwang ng International Women’s Day sa Plaza Miranda, Angeles City, Pampanga, noong March 8.

Sa isang sulat na ipinadala ng Student Discipline Unit (SDU) ng Student Affairs and Services (SAS) Office ng pamantasan kahapon, March 16, 3 mag-aaral umano na kumakatawan sa Tindig - TSU, isang partidong pampulitikal sa pamantasan, ang lumabag sa University Student Manual at sa Approved Student Discipline Manual.

Ilan sa mga sinasabing paglabag ay: (1) Holding of any event by an unaccredited student organization, (2) spearheading or knowingly joining a student activity conducted by an unaccredited student organization, (3) willful disregard or violation of established policies and regulations of the University, at (4) unauthorized participation of Tindig TSU in the rally may be prejudicial to the university’s best interest.

Ayon din sa sulat na natanggap ng mga mag-aaral, magreresulta sa 7 hanggang 15 araw ng suspension penalties ang mga naisaad na “major offenses” na siguradong makaaapekto sa pag-aaral ng mga ito, lalo pa sa ilalim ng palpak na implementasyon ng distance learning.

Bagamat aminado ang Tindig TSU na sila ay hindi isang accredited organization sa pamantasan para sa kasalukuyang academic year, hindi pa rin nito binibigyan ng karapatan ang SDU ng SAS Office para supilin ang kalayaan sa pagpapahayag at anumang anyo ng pagtutol mula sa partidong pampulitikal at mga mag-aaral ng institusyon, kung mayroon man.

Sa kabilang banda, ipinapanawagan ng mga mag-aaral ang masinsinang pagtataguyod ng TSU sa kanilang pangunahing karapatan para sa malayang pagpapahayag gaya ng tiniyak ng Bill of Rights ng 1987 Constitution of the Republic of the Philippines at mga international laws and treaties na sinisiguro ang mga naturang karapatan.

Buong tapang na nakikiisa ang Tindig CLSU sa Tindig TSU at mga mag-aaral ng Tarlac State University para sa pagtatanggol sa pundamental na karapatan para sa malayang pagpapahayag at pag-oorganisa.

Mariin na tinututulan ng Tindig CLSU ang lantarang pagbabaluktot ng TSU sa batas upang supilin ang boses ng kanilang mga estudyante.

May kaugnayan man ang mga pinaparatangang mag-aaral sa Tindig TSU o wala, o piliin man nilang makiisa sa mga pagkilos ng masang api, hinding-hindi magiging makatwiran ang pagpigil ng pamantasan sa mga pagpapasyang ginagarantiyahan ng batas.

Ang pagsasabuhay ng Martial Law ni Marcos sa mga pamantasan, sa pamamagitan ng mga university administrators, ay pambubusabos sa kasaysayan ng kilusang kabataan-estudyante sa bansa na nangahas na nakibaka laban sa pagpapatahimik sa mga student organizations at campus publications.

TSU threatens 3 students with suspension after allegedly joining a mobilization

Three students from Tarlac State University (TSU) face a possibility of suspension after allegedly joining a mobilization celebrating International Women’s Day (IWD) last March 8 in Plaza Miranda, Angeles City, Pampanga.

In a letter communicated by the Student Discipline Unit (SDU) of the university’s Student Affairs and Services (SAS) Office on March 16, the three students allegedly representing Tindig TSU, a political party in the university, committed violations of the University Student Manual and the Approved Student Discipline Manual.

Some of the alleged violations are the following: (1) Holding of any event by an unaccredited student organization, (2) spearheading or knowingly joining a student activity conducted by an unaccredited student organization, (3) willful disregard or violation of established policies and regulations of the University, and (4) unauthorized participation of Tindig TSU in the rally may be prejudicial to the university’s best interest.

These “major offenses” correspond to seven to 15-day suspension penalties which would impede students’ learning.

According to Tindig TSU, they recognize that they are not an accredited organization in the university for the current academic year, however, the SDU of SAS Office does not have the right to suppress any form of dissent, speech, and expression from the organization, if any.

On the other hand, the students demand the institution to intensively uphold their fundamental right to free speech and to expression as ensured under the Bill of Rights of the 1987 Constitution of the Republic of the Philippines and the international laws and treaties guaranteeing such rights.

They also asserted that the institution does not have jurisdiction over the students’ activities outside the school premises.

“The Student Affairs and Services Office does not have the authority to intrude in my personal life. It is disappointing how the institution maliciously tags me as a violator of the Student Discipline Manual. I am not in any way affiliated with Tindig TSU and I also did not join the International Women’s Day mobilization. However, even if I did, exercising my democratic rights should never be questioned, most especially by my university,” one of the students said.

With this, the organization demands the institution to disclose the identities of their sources in line with their fundamental right to face their accusers as well as the pieces of evidence they possess.

Furthermore, the students had already taken legal actions against the vilification and filed a counterstatement against the SAS Office.

“Marcosian martial law is long dead; authoritarian legalism is passe and has no place in civil society. Please do not revive it in our esteemed university as constitutional guarantees are cherished rights borne out of the blood and sweat of the freedom-loving Filipinos who bravely fought the fascist dictatorship,” Atty. Ericson Dela Cruz, the students’ legal counsel said.

“What you’re actually doing is a form of lawfare. It is a recent development in international law that pertains to the authoritarian use of law and legalism to suppress any form of dissent and neutralize dissenters. Scores have died because of this. Please note that my client will never take this lightly,” he added.

Tindig TSU and the students condemn the institution’s malicious tagging of students as violators of the Student Manual and upfront suppression of their democratic rights as they continue to stand and fight for the rights of the toiling masses.
