Ano ba ang mas ok sa Income Tax Filing para sa mga Individual Taxpayers?
8% ba? Optional Standard Deduction? Allowable Itemized Deduction?
Ito ang tanong na mukhang simple…
pero kapag mali ang sagot, pwedeng masakit sa bulsa.
Kasi sa taxation, hindi porket “mas madali” ay mas tama.
Hindi porket “mas mababa ang computation” ay automatic na mas safe.
At hindi porket “ginagawa ng iba” ay dapat gayahin mo na rin, dahil apparently tax compliance is not a group assignment na pwedeng kopyahan sa seatmate.

Hindi lang invoice ang pwedeng support sa income tax deductions.
Pero teka, bago may mag-celebrate na parang nanalo sa raffle ng “wala nang documents,” linawin natin.
Under Section 34(A)(1)(b) of the Tax Code, as amended, deductions must be substantiated with official receipts OR other adequate records.
Meaning?
Hindi porket walang invoice, automatic disallowed agad.
Pero hindi rin ibig sabihin na “kahit ano na lang” pwede na.
Kailangan may sufficient evidence.
Kailangan may adequate records.
Kailangan maipakita na ang expense ay tunay, related sa business, at properly documented.
Dito madalas nagkakaroon ng problema during tax compliance and BIR audit:
❌ May expense pero walang matinong support
❌ May resibo pero hindi connected sa business
❌ May payment pero walang proper records
❌ May deduction pero hindi ma-explain

"Hindi mo pa nga sinasagot yung protest ko… nag-i-issue ka na agad ng Warrant of Distraint/Levy?"
Kapag may WDL na, hindi na ito simpleng “tax issue” lang.
Puwedeng ma-freeze ang accounts.
Puwedeng maapektuhan ang cash flow.
Puwedeng maistorbo ang operations.
Puwedeng mataranta ang accounting team.
Puwedeng mapilitan ang management na magbayad kahit hindi pa malinaw kung final, valid, at collectible na ba talaga ang assessment.
At doon madalas nangyayari ang pinakamahal na pagkakamali:
Nagbayad dahil natakot.
Nanahimik dahil hindi alam ang remedy.
Sumunod agad dahil akala wala nang laban.
Pero may proseso.
May due process.
May karapatan ang taxpayer.
At may mga pagkakataon na hindi dapat basta-basta itinutuloy ang collection action habang hindi pa nareresolba nang maayos ang protest.
Sa Light Rail Transit Authority v. CIR, malinaw ang Supreme Court Ruling: hindi puwedeng unahin ang collection remedy kung hindi pa maayos na nareresolba ang protest ng taxpayer.
Kaya kapag may WDL, hindi dapat puro panic.
Dapat tinatanong:
✅ Nasagot na ba ang protest?
✅ Final and collectible na ba talaga ang assessment?✅ Proper ba ang service ng notices?
✅ Na-observe ba ang due process?
✅ Valid ba ang basis ng WDL?
✅ Ano ang available remedies ng taxpayer?
✅ Ano ang dapat gawin ng management, officers, accounting team, or finance team?
Dahil sa totoong buhay, ang hindi marunong sa proseso, madaling takutin.
Ang madaling takutin, madaling mapilit.
Ang madaling mapilit, madaling magbayad kahit may legal remedy pa.
At kung organization kayo, hindi dapat doon pa kayo matuto kapag may notice na sa mesa, may bank garnishment na, o may collection action na kumakatok.
Prevention is cheaper than panic.
Training is cheaper than penalties.
Knowledge is cheaper than damage control.

Sabi ng buwaya.
Pero kung iisipin mo…
₱500 kapalit ng ilang taon na serbisyo?

₱500 kapalit ng kalsada, eskwelahan, health center, trabaho, negosyo, at kinabukasan?
Ang mura naman ng pagkakabili sa atin. Parang naka-sale ang prinsipyo, tapos tayo pa ang talo sa dulo. Nakakagalit, pero mas nakakagalit kasi paulit-ulit nang nangyayari.
Kaya minsan, mas magandang sagot:

Kailangan ng edukasyon.

Kailangan ng good governance.

Pero nasaan ang actual facts?

As held by the Supreme Court:
“In order to stand the test of judicial scrutiny, the assessment must be based on actual facts.” (Collector of Internal Revenue v. Benipayo, G.R. No. L-13656, January 31, 1962)
The BIR may assess based on evidence obtainable.
