Statement of CIBAC Party-List on circulating social media posts regarding alleged DPWH allocations

CIBAC Party-List categorically denies and condemns the false and misleading social media posts circulating online which claim that CIBAC received ₱3.41 billion worth of project allocations or is included among party-list groups with such allocations from the Department of Public Works and Highways (DPWH). These posts are utterly deceptive, malicious, and misleading portrayal of CIBAC public services.

There is NEVER a record nor document from the DPWH which identifies CIBAC as a recipient of project allocations being claimed by these posts. We encourage the public to be vigilant and only rely on official government sources rather than unverified graphics and social media narratives
that distort the truth.

Thus, we call on the public to reject and fight the spread of these falsities. Please REPORT any social media account or page which posts, shares and peddles these fake news.

Let us protect the truth for only the truth can set us free.

𝐈𝐧𝐯𝐚𝐥𝐢𝐝 𝐒𝐞𝐚𝐫𝐜𝐡 ⁣

A 𝐟𝐢𝐧𝐞-𝐨𝐧𝐥𝐲 𝐭𝐫𝐚𝐟𝐟𝐢𝐜 𝐯𝐢𝐨𝐥𝐚𝐭𝐢𝐨𝐧 - no helmet, no license, or no OR/CR - does not allow for arrest. Because there is no valid arrest, the police cannot conduct a search incidental to a lawful arrest to look for evidence.⁣
⁣
𝐕𝐚𝐥𝐢𝐝 𝐒𝐞𝐚𝐫𝐜𝐡 (𝐒𝐭𝐨𝐩 𝐚𝐧𝐝 𝐅𝐫𝐢𝐬𝐤)⁣
⁣
However, if the 𝐭𝐫𝐚𝐟𝐟𝐢𝐜 𝐯𝐢𝐨𝐥𝐚𝐭𝐢𝐨𝐧𝐬, 𝐭𝐚𝐤𝐞𝐧 𝐭𝐨𝐠𝐞𝐭𝐡𝐞𝐫, create a genuine reason to suspect an illicit act, the police can frisk the body of a traffic violator.⁣
⁣
In 𝘗𝘢𝘣𝘭𝘰, the Court upheld the stop and frisk search that yielded a 𝐟𝐢𝐫𝐞𝐚𝐫𝐦 𝐚𝐧𝐝 𝐚𝐦𝐦𝐮𝐧𝐢𝐭𝐢𝐨𝐧 because of a totality of circumstances:⁣
1. The riders were “𝐫𝐢𝐝𝐢𝐧𝐠 𝐢𝐧 𝐭𝐚𝐧𝐝𝐞𝐦”⁣
2. A 𝐭𝐚𝐦𝐩𝐞𝐫𝐞𝐝 𝐥𝐢𝐜𝐞𝐧𝐬𝐞 𝐩𝐥𝐚𝐭𝐞 (covered with paper)⁣
3. No 𝐝𝐫𝐢𝐯𝐞𝐫’𝐬 𝐥𝐢𝐜𝐞𝐧𝐬𝐞 ⁣
4. No vehicle 𝐨𝐟𝐟𝐢𝐜𝐢𝐚𝐥 𝐫𝐞𝐜𝐞𝐢𝐩𝐭 (OR) and 𝐜𝐞𝐫𝐭𝐢𝐟𝐢𝐜𝐚𝐭𝐞 𝐨𝐟 𝐫𝐞𝐠𝐢𝐬𝐭𝐫𝐚𝐭𝐢𝐨𝐧 (CR)⁣

When faced with these successive circumstances, the police officers suspected that perhaps the riders were armed and/or conducting some illicit activity.⁣

𝐒𝐭𝐫𝐢𝐜𝐭 𝐋𝐢𝐦𝐢𝐭𝐬 𝐭𝐨 𝐭𝐡𝐞 𝐒𝐞𝐚𝐫𝐜𝐡 ⁣

A valid stop and frisk search is:⁣
1. Strictly limited to a "𝐩𝐚𝐭-𝐝𝐨𝐰𝐧" 𝐨𝐟 𝐨𝐮𝐭𝐞𝐫 𝐜𝐥𝐨𝐭𝐡𝐢𝐧𝐠.⁣
2. Conducted for the sole purpose of discovering weapons 𝐭𝐨 𝐞𝐧𝐬𝐮𝐫𝐞 𝐨𝐟𝐟𝐢𝐜𝐞𝐫 𝐬𝐚𝐟𝐞𝐭𝐲, not to find evidence of a crime.⁣

𝐂𝐚𝐧 𝐚𝐧 𝐎𝐫𝐝𝐢𝐧𝐚𝐧𝐜𝐞 𝐕𝐢𝐨𝐥𝐚𝐭𝐨𝐫 𝐛𝐞 𝐀𝐫𝐫𝐞𝐬𝐭𝐞𝐝?⁣⁣

In 𝐏𝐚𝐭𝐨𝐭𝐨𝐲 𝐯. 𝐏𝐞𝐨𝐩𝐥𝐞 (𝘎.𝘙. 𝘕𝘰. 257910. 𝘔𝘢𝘳𝘤𝘩 4, 2025), the Supreme Court had a chance to decide that the arrest of an ordinance violator was proper. It also outlined cases where arrests due to ordinance violations were previously ruled invalid.⁣⁣

An arrest is proper if the ordinance violated imposes the penalty of 𝐈𝐌𝐏𝐑𝐈𝐒𝐎𝐍𝐌𝐄𝐍𝐓.⁣⁣

In 𝘗𝘢𝘵𝘰𝘵𝘰𝘺, the Court upheld the arrest of a man 𝐝𝐫𝐢𝐧𝐤𝐢𝐧𝐠 𝐛𝐞𝐞𝐫 𝐢𝐧 𝐩𝐮𝐛𝐥𝐢𝐜 because Manila City Ordinance No. 5555 specifically included a penalty of imprisonment (15 days to 6 months) in addition to a fine.⁣⁣

There can be no lawful arrest if the violation is punishable by a 𝐅𝐈𝐍𝐄 𝐎𝐍𝐋𝐘. ⁣⁣

2. 𝐔𝐫𝐢𝐧𝐚𝐭𝐢𝐧𝐠 𝐢𝐧 𝐩𝐮𝐛𝐥𝐢𝐜 (punishable by fine only).⁣⁣
3. 𝐌𝐢𝐧𝐨𝐫 𝐭𝐫𝐚𝐟𝐟𝐢𝐜 𝐯𝐢𝐨𝐥𝐚𝐭𝐢𝐨𝐧𝐬, such as entering a one-way street.⁣⁣

𝐈 𝐚𝐥𝐰𝐚𝐲𝐬 𝐜𝐚𝐥𝐥 𝐨𝐧 𝐭𝐡𝐞 𝐧𝐚𝐦𝐞 𝐨𝐟 𝐦𝐲 𝐋𝐨𝐫𝐝 𝐚𝐧𝐝 𝐒𝐚𝐯𝐢𝐨𝐫 𝐉𝐞𝐬𝐮𝐬 𝐂𝐡𝐫𝐢𝐬𝐭.⁣

It is only by Jesus’ name and our faith that we will be made strong. As Peter exhorts: “𝐀𝐧𝐝 𝐞𝐯𝐞𝐫𝐲𝐨𝐧𝐞 𝐰𝐡𝐨 𝐜𝐚𝐥𝐥𝐬 𝐨𝐧 𝐭𝐡𝐞 𝐧𝐚𝐦𝐞 𝐨𝐟 𝐭𝐡𝐞 𝐋𝐨𝐫𝐝 𝐰𝐢𝐥𝐥 𝐛𝐞 𝐬𝐚𝐯𝐞𝐝” (Acts 2:21).⁣

In 𝘑𝘢𝘷𝘪𝘦𝘳, there was no chain of custody form or any documentary evidence of turnover.⁣

𝐏𝐫𝐞𝐬𝐞𝐫𝐯𝐚𝐭𝐢𝐨𝐧 ⁣
⁣
Officers must be able to testify about the 𝐩𝐫𝐞𝐜𝐚𝐮𝐭𝐢𝐨𝐧𝐚𝐫𝐲 𝐦𝐞𝐚𝐬𝐮𝐫𝐞𝐬 they observed: ⁣
(1) how the knife was 𝐬𝐭𝐨𝐫𝐞𝐝, and ⁣
(2) how it was 𝐬𝐞𝐩𝐚𝐫𝐚𝐭𝐞𝐝 from other evidence in the station to avoid intermingling.⁣

In 𝘑𝘢𝘷𝘪𝘦𝘳, the officers failed to testify about the said precautionary measures.⁣

When the PNP Manual procedures are not followed, the 𝐞𝐯𝐢𝐝𝐞𝐧𝐭𝐢𝐚𝐫𝐲 𝐯𝐚𝐥𝐮𝐞 of the weapon is not preserved, which often leads to 𝐚𝐜𝐪𝐮𝐢𝐭𝐭𝐚𝐥.⁣
