सपना प्रधान मल्ल आजदेखि नेपालको कार्यवाहक प्रधानन्यायाधीशको जिम्मेवारी सम्हाल्नु भएको छ। उहाँ नेपालको न्याय क्षेत्रमा लामो अनुभव र योगदान राख्ने वरिष्ठ न्यायाधीशका रूपमा परिचित हुनुहुन्छ। कार्यवाहक प्रधानन्यायाधीशको रूपमा उहाँले न्यायपालिकाको नेतृत्व गर्दै कानुनी शासन, पारदर्शिता र निष्पक्ष न्याय सुनिश्चित गर्न महत्वपूर्ण भूमिका खेल्नु हुने अपेक्षा गरिएको छ।

Sapana Beyond Judiciary

Sapana Pradhan Malla is far more than the black robes she wears as a Justice of the Supreme Court of Nepal; she is a relentless force of nature who redefined the meaning of "activism from the bench." Long before her elevation to the judiciary, she was a fierce litigator and a grassroots advocate who took on the most deeply entrenched patriarchal structures of Nepali society. Her identity is rooted in a rare blend of intellectual grit and deep-seated empathy, particularly for the voiceless. As a woman, she navigated a legal system built by men for men. Yet, she managed to dismantle discriminatory laws, most notably through her landmark legal battles for women's property rights and the criminalization of marital r**e, long before it was politically "safe" to do so. Sapana is a woman of profound conviction who views the law not just as a set of static rules, but as a living, breathing tool for social engineering. Beyond the courtroom, she is known for her resilience, having transitioned from the heat of street activism and constitutional drafting in the Constituent Assembly to the composed, analytical world of the Supreme Court without losing her core mission: dignity for all. Her life’s work reflects a person who refuses to accept the status quo, possessing a restless spirit that constantly seeks to bridge the gap between "legal justice" and "social justice," making her a pivotal figure in Nepal's modern history who chose to lead by breaking glass ceilings rather than just standing under them.

In the landmark 2006 case of Sapana Pradhan Malla v. Office of the Prime Minister, the Supreme Court of Nepal struck down a discriminatory law that set the legal marriage age at 18 for women and 22 for men. Led by the Forum for Women, Law and Development (FWLD), the petition argued that this discrepancy violated constitutional guarantees of gender equality and contributed to negative social outcomes for women, such as higher maternal mortality and limited educational opportunities. The Court’s ruling forced a legislative revision, ultimately leading to the current standardized legal marriage age of 20 years for all genders, marking a pivotal victory for human rights and gender justice in Nepal.

आशिका तामाङ: सडकको आवाजदेखि संसदको यात्रासम्म!

नेपाली समाजमा एउटा यस्तो नाम, जसले अन्यायको विरुद्धमा बोल्न कहिल्यै हिचकिचाइनन्। 'Gen Z' आन्दोलनको राप होस् वा पिँधमा परेका पीडितको आँसु, आशिका तामाङ सधैँ अग्रपङ्क्तिमा उभिएकी छिन्। आज उनी केवल एक सामाजिक अभियन्ता मात्र होइनन्, परिवर्तनको एउटा बलियो राजनीतिक शक्ति बनेर उदाएकी छिन्।

-अन्याय विरुद्धको चट्टानी आवाज
भदौ २४ को त्यो ऐतिहासिक आन्दोलन र त्यसपछिका कठिन दिनहरूमा आशिकाले देखाएको साहस अविस्मरणीय छ। आन्दोलनका क्रममा मारिएका र घाइते भएका ७६ जना पीडित परिवारका लागि न्याय माग्न उनी सडकदेखि अस्पतालसम्म धाइन्। सरकारी दमनका विरुद्ध र न्यायको खोजीमा उनले जसरी आवाज बुलन्द गरिन्, त्यसले उनलाई हजारौँ युवा र महिलाहरूको 'रोल मोडेल' बनाएको छ।

आशिका अब सडकबाट सदनतर्फ पाइला चाल्दैछिन्। उनले राष्ट्रिय स्वतन्त्र पार्टी (RSP) मार्फत बालेन शाह र रवि लामिछानेको नेतृत्वदायी अभियानलाई साथ दिँदै आगामी निर्वाचनमा उम्मेदवारी दिने घोषणा गरेकी छिन्।

किन आशिका? किनकि उनले बुझेकी छिन्, केवल विरोध गरेर मात्र पुग्दैन, नीति निर्माण गर्ने ठाउँमा पुगेर पद्धति बदल्न आवश्यक छ।
युवा र महिलाको प्रतिनिधित्व: उनको उम्मेदवारीले राजनीतिमा महिलाहरूको अर्थपूर्ण सहभागिता र विशेषगरी सिमान्तकृत समुदायको आवाजलाई राज्यको मूलधारमा पुर्‍याउने निश्चित छ।

-एउटा नयाँ सुरुवात
अन्यायमा परेकाहरूका लागि 'आशाको किरण' बनेकी आशिकाले बालेन र रविको भिजनसँग हात मिलाउनुले नेपाली राजनीतिमा एउटा नयाँ समीकरण तयार गरेको छ। उनको यो यात्राले प्रमाणित गर्छ कि यदि इच्छाशक्ति भएमा एउटी साधारण महिलाले पनि देशको भविष्य बदल्ने हिम्मत राख्न सक्छिन्।

न्यायको मन्दिरमा महिला नेतृत्व, कहाँ छौँ हामी? ⚖️

नेपालको सर्वोच्च अदालत, जहाँ देशको न्याय र विधिको शासनको रक्षा हुन्छ। आज हामी सर्वोच्च अदालतको वर्तमान संरचना र त्यहाँ महिला न्यायधीशहरूको उपस्थितिलाई 'डिकोड' (Decode) गर्दैछौँ।

वर्तमान अवस्था: अहिले सर्वोच्च अदालतमा सम्माननीय प्रधान न्यायाधीश श्री प्रकाशमान सिंह राउतको नेतृत्वमा १८ जना स्थायी न्यायाधीशहरू हुनुहुन्छ। यो १८ जनाको 'लाइन-अप' मा महिलाको उपस्थिति यस प्रकार छ:

🔹न्यायमूर्ति सपना प्रधान मल्ल: उहाँ अहिले वरिष्ठताको रोलक्रममा प्रधान न्यायाधीश पछिको दोस्रो स्थानमा हुनुहुन्छ। नेपालले छिट्टै अर्को महिला प्रधान न्यायाधीश पाउने आशा उहाँमा निहित छ। सपना प्रधान मल्ल प्रधान न्यायाधीश बन्नु भनेको केवल एउटा पद भरिनु मात्र होइन; यो नेपालको न्यायपालिकामा 'लैङ्गिक समानता' को एउटा नयाँ अध्याय सुरु हुनु हो। उहाँको नेतृत्वले वर्षौँदेखि ओझेलमा परेका महिलाका मुद्दाहरूलाई सर्वोच्चको इजलासदेखि समाजको पिँधसम्म नयाँ न्याय दिने विश्वास गरिएको छ।"

🔹 माननीय न्यायाधीश शारङ्गा सुवेदी: उहाँ सपना प्रधान मल्ल पछिको ६ पुरुष न्यायाधीशहरूको अन्तरालपछि रोलक्रममा हुनुहुन्छ।

🔹 माननीय न्यायाधीश शान्तिसिंह थापा: उहाँ हालै नियुक्त हुनुभएको र अहिलेको रोलक्रममा अन्तिम स्थानमा हुनुहुन्छ।

हाम्रो विश्लेषण: कुल १९ जना (१ प्रधान न्यायाधीश + १८ न्यायाधीश) मध्ये मात्र ३ जना (करिब १५.७%) महिला हुनुहुन्छ।

"न्याय तब मात्र पूर्ण हुन्छ, जब न्याय गर्ने ठाउँमा समाजका सबै वर्ग र लिङ्गको समानुपातिक प्रतिनिधित्व हुन्छ।"

किन यो विषय महत्वपूर्ण छ?

१. प्रेरणा: सपना प्रधान मल्ल, शारङ्गा सुवेदी र शान्तिसिंह थापा केवल न्यायाधीश मात्र हुनुहुन्न, उहाँहरू हजारौँ कानुन पढ्ने छात्राहरूका लागि आशाका किरण हुनुहुन्छ।
२. अझै लामो यात्रा: १८ जनामा ३ जना हुनु प्रगति त हो, तर ५०% जनसङ्ख्या ओगट्ने महिलाहरूको लागि यो सङ्ख्या अझै न्यून छ।
३. भविष्यको आशा:
सपना प्रधान मल्ल 'Next in line' हुनुले हामीलाई फेरी एकपटक न्यायपालिकाको सर्वोच्च पदमा महिला पुग्ने विश्वास दिलाएको छ। उहाँको नेतृत्वमा पुग्ने सम्भावनाले नेपालको संविधानले परिकल्पना गरेको 'समानुपातिक र समावेशी' राज्यको सपनालाई साकार पार्नेछ, जसले आउने पुस्ताका हजारौँ महिला कानुन व्यवसायीहरूलाई सर्वोच्चको कुर्लीसम्म पुग्ने साहस र बाटो देखाउनेछ।
