πΊπΈ HOW COULD TINUBU BE ARRESTED IN THE U.S.? β KANUβS LAWYER EJIMAKOR EXPLAINS
Lawyer Aloy Ejimakor, who represents Mazi Nnamdi Kanu, has discussed the circumstances under which, in his view, President Bola Tinubu could potentially face legal action in the United States.
Ejimakor argued that Tinubu's position as Nigeria's sitting president raises questions of head-of-state immunity and that any future legal action would depend on applicable U.S. law and the circumstances at the time.
He also discussed the 1990s U.S. forfeiture proceedings involving funds associated with Tinubu, stressing that civil forfeiture is legally distinct from a criminal conviction.
The U.S. Supreme Court has held that certain in-rem civil forfeiture proceedings are civil rather than criminal punishment.
Meanwhile, the Nigerian Presidency has maintained that the current U.S. litigation involving FBI records is a civil Freedom of Information Act records-disclosure dispute, not a criminal case against Tinubu, and says the court has not found him guilty of criminal wrongdoing.
The Presidency has also said that a 2003 U.S. records check found no criminal arrest records, wants or warrants for Tinubu at that time.
