كان أبو سفيان يدخل مسجد المدينة وهو على شركه، واستقبل النبى صلى الله عليه وسلم " نصارى نجران فى مسجد المدينة، ولما حان وقت صلاتهم صلوا فى المسجد إلى المشرق، وقال فيهم عليه الصلاة والسلام " دعوهم ".

قال ابن حجر فى فتح البارى عن هذه المسألة:

فيه مذاهب، فعن الحنفية الجواز مطلقا، وعن المالكية والمزنى المنع مطلقا، وعن الشافعية التفصيل بين المسجد الحرام وغيره، للآية، وقيل: يؤذن للكتابي خاصة، وحديث الباب يرد عليه، فإن ثمامة ليس من أهل الكتاب انتهى.
أحمد. وفى رواية عنه أيضا أنه لا يجوز له الدخول إلا بإذن المسلمين، ويؤيدها أن عليا رضى الله عنه رأى مجوسيا وهو على المنبر وقد دخل المسجد، فنزل وضربه وأخرجه من أبواب كندة، فإن أذن له المسلمون جاز دخوله، بدليل أن النبى صلى الله عليه وسلم أنزل أهل الطائف فى المسجد قبل أن يسلموا، وقال سعيد بن المسيب:
قال العلماء يجوز لاهل الكتاب أن يدخلوا المسجد باذن المسلمين و بأخذيتهم إذا كان خاليا من النجاسة.
