CAN POLICE ARREST YOU EVEN WHEN THEY HAVE NO EVIDENCE
If the police search for evidence and find nothing can they still arrest the person?
The simple answer is: YES an arrest can happen even before the police have found evidence
But wait! This does NOT mean the police can arrest anybody they like
The police do not always need to have the full evidence in their hands before making an arrest.
For example imagine someone reports to the police:
Mr. John stole my phone.
The police may investigate the matter and have reasonable grounds to suspect John.
Even if they have not yet recovered the phone or found the final evidence they may arrest John for the purpose of investigation, provided the arrest is legally justified.
But there is an important limit.
The police cannot simply say we suspect you and keep you in detention without proper reason.
There must be a lawful basis for the arrest.
And remember this:
Being arrested does NOT mean you are guilty
An arrest is only part of the investigation. The police still have to investigate the allegation and gather evidence
If the investigation does not establish a case against you, you should not be kept in custody indefinitely simply because the police are still looking for evidence
Also the police must respect the person's constitutional rights including the right to remain silent and the right to consult a legal practitioner
So if the police arrest you and you say:
But you haven't found any evidence against me!
That statement alone does not automatically make the arrest illegal.
The real question is:
Was there a lawful and reasonable basis for the arrest?
That is why it is important to know your rights
ARREST ≠ GUILT
The police can investigate you
The police can arrest you where the law permits it.
But the police cannot punish you because they suspect you committed a crime.
