Australian Migration New Strategy has been published today. Here are some key points:
The strategy outlines eight key actions:
1. Targeting temporary skilled migration to address skills needs and promote worker mobility.
2. Reshaping permanent skilled migration to drive long-term prosperity.
3. Strengthening the integrity and quality of international education.
4. Tackling worker exploitation and misuse of the visa system.
5. Planning migration to ensure the right skills in the right places.
6. Tailoring regional visas and the Working Holiday Maker program to support regional Australia and its workers.
7. Deepening people-to-people ties in the Indo-Pacific.
8. Simplifying the migration system to enhance the experience for migrants and employers.
Certain aspects of the strategy are pending finalization after additional consultations, as recommended by the Parkinson review.
Key announcements include:
Migration Program Planning: The government plans to extend migration planning beyond the current 12-month cycle to address critical skills shortages and foster better collaboration with states and territories. Net overseas migration is anticipated to decrease from 510,000 in 2022-23 to 375,000 in the next fiscal year and further to 250,000 in 2024-25.
π International Students and Temporary Visa Holders: The strategy addresses the growth in international student numbers and an increase in temporary visa holders. Notably, a three-tiered system of visa pathways is proposed to replace the TSS SC 482, catering to different income brackets.
π Skilling Australians Fund: Consideration will be given to collecting the Skilling Australians Fund (SAF) in smaller increments over time, reflecting the greater freedom of visa holders to change employers.
π Labour Market Testing: Labour Market Testing (LMT) is set to be streamlined, with changes such as abolishing the requirement to advertise on the Workforce Australia site and extending the advertising period from 4 to 6 months.
π Points Tests and Temporary Graduate Visas: The points test will undergo review, and a new analysis-based points test will be developed to identify independent migrants making significant contributions. Temporary Graduate Visas will see substantial changes to better align with the skills required by Australian employers.
π Student Visas and Education Agents: Significant changes are proposed for the student visa program, including higher English language requirements and a focus on retaining tertiary university courses. Regulation of education agents will be expanded through the Office of the Migration Agents Registration Authority.
π Regional Migration: Acknowledging the shortcomings of current regional migration strategies, the government aims to work closely with states and territories to better target regional population needs, with fast-tracked regional visa applications.
π Working Holiday Makers and Global Talent and Business Skills: No immediate changes are announced for the Working Holiday Maker program. The Global Talent program will be more sharply focused, considering a new 'talent and innovation' visa. The Business Innovation and Investment Program will be reviewed, addressing the disproportionate investment in certain sectors.
π Foreign Investment Fees for Property: Foreign investors buying established homes will face increased fees and higher penalties for leaving them vacant.
π Registered Migration Agents: The government will explore limiting the involvement of unregistered overseas providers in the migration system and enhance the regulation of registered migration agents to combat unscrupulous immigration assistance providers. This includes considering stricter monitoring and increased financial penalties.

The number of NT nomination applications received under the GSM program has now exceeded the available allocations for the 2023-24 program year.
Migration NT will stop accepting new GSM nomination applications from close of business on Monday 4 December 2023.

πThe COVID-19 concession period will cease on 25 November 2023. From early 2020, the COVID-19 pandemic resulted in international travel restrictions, and deteriorating business and employment conditions and concessions were given for applicants of certain visa subclasses affected by travel restrictions and which made it difficult for them to meet visa requirements.

From 25 November 2023, all applications for any stream of the Temporary Graduate visa (TGV) program must be lodged in Australia. Subsequent entrant applications can be lodged in or outside of Australia. The ability to grant applications to applicants who are either in or outside of Australia (but not in immigration clearance) will continue.

NSW Important updateπ£π£
There are two pathways to NSW nomination for this visa:
πPathway 1 β Apply directly to Investment NSW if you have an established work history with a regional NSW-based employer.
πPathway 2 β Be invited to apply by Investment NSW.
1οΈβ£ Pathway
To apply directly under 'Pathway 1', you must be currently living and working in a designated regional area of NSW and have continuously done so for the past 12 months.
Your qualifying skilled employment in the twelve months immediately before applying must be:
With a single regional NSW-based employer; and
β
In your nominated (or closely related) occupation; and
β
Deemed skilled by NSW; and
β
Paid a minimum of the TSMIT salary level of $70,000 (prorated if under 38 hours per week) from your qualifying employer in your nominated (or closely related) occupation.
2οΈβ£ Pathway
To be considered for NSW nomination under 'Pathway 2' you must:
β
Check Eligibility: Before submitting your EOI in Skill Select, ensure you meet both the visa and NSW nomination eligibility requirements.
β
Submit Your EOI: If you meet the criteria, submit an EOI in Skill Select, specifically requesting NSW nomination for this visa only. Should you be invited to apply, you'll need to support every point claim in your EOI with valid (i.e. non-expired) documentation.
β
Be Invited: NSW holds invitation rounds ongoing throughout the financial year. All EOIs that meet the guidelines are considered, but preference is given to occupations in NSW target sectors. Important: because of the exceptionally high demand for NSW nomination, we strongly encourage anyone considering NSW nomination to explore all other migration pathways and not wait to be invited.

Respond Promptly if Invited: You'll have 14 days to complete your application for NSW nomination after being invited. When you apply, you will need to provide valid documents to substantiate every claim made in your EOI. This 14-day window will not be extended.

Wait For Your Nomination Assessment: Your application will typically be assessed within six weeks after payment. To help us stick to this timeline, please refrain from contacting us for updates during this period.

πTemporary Skill Shortage (subclass 482)

From 25 November 2023* the Government plans to remove the limit on the number of Short-term stream TSS visa applications that visa holders can make in Australia.
This change is intended to apply to new TSS visa applications made on or after 25 November 2023. Short-term-stream TSS holders with visas expiring before 25 November 2023 will need to travel outside Australia to lodge a third short-term-stream TSS application.
πEmployer Nomination Scheme (subclass 186) Temporary Residence Transition Stream.
Changes planned for TRT stream nomination requirements include:
Allowing employers to nominate holders of all streams of TSS visas (including Short-term and Labour Agreement streams).
Removing the requirement for nominated occupations for the TRT stream to be assessed against a skilled migration occupation list.
πChanges planned for TRT stream visa application requirements include:
Updating age exemptions for regional medical practitioner applicants and high-income earning applicants aged 45 years and over to allow for a two-year pathway.
Ending COVID-19-related age exemptions that will become redundant as a result of the two-year pathway.
