Building rapport is the foundation of successful mediation. It involves quickly establishing trust, empathy, and mutual respect so parties feel safe enough to collaborate. Mediators build this connection through active listening, observing non-verbal cues, mirroring communication styles, and showing a genuine, neutral interest in each person's perspective.

Rapport helps disarm defensive participants, moving them away from rigid positions and toward creative problem-solving. To build and maintain it effectively, mediators rely on several key strategies:

•Active Listening: Validate participants' feelings by reflecting back what you hear. Using the parties' own exact words rather than paraphrasing can assure them they are truly being understood.
•Pacing and Leading: Match the parties' pacing—such as speaking speed, tone, and body language—to build an initial connection. Once that trust is established, the mediator can gently "lead" them toward settlement.
•Setting Expectations: Clearly outline ground rules, confidentiality, and your role as a strictly neutral facilitator so parties know what to expect
•Avoiding Pitfalls: Be sincere. Over-exaggerating techniques like mirroring can feel manipulative and cause a participant to shut down

The core principles of mediation are voluntary participation, confidentiality, impartiality, and self-determination. These foundational rules ensure that conflict resolution remains fair, private, and entirely controlled by the people involved rather than an outside judge.

Core Rules of Mediation
•Voluntary: Everyone joins by choice and can walk away at any time. No one is forced into a final agreement.
•Confidential: Private talks and shared details stay secret. They cannot be used later in a court case.
•Impartial: The mediator stays neutral. They do not pick a side, judge who is right, or have a personal stake in the result.
•Self-Determination: The people in the dispute make all the choices. The mediator guides the talk but never makes decisions for them.

Overcoming mediation barriers—such as emotional tension, communication breakdowns, and positional bargaining—requires proactive strategies. Mediators navigate these roadblocks by building trust, holding separate caucus sessions to explore underlying interests, and ensuring all parties enter the process with realistic risk analyses and proper preparation
Mediation is a highly preferred Alternative Dispute Resolution (ADR) mechanism in Kenya, but it frequently faces distinct hurdles.

Key challenges and actionable ways to overcome them include:

•Emotional Tension & Positional Bargaining: Parties often enter mediation rigid, angry, or focused solely on "winning".
• Solution: Skilled mediators use separate carrus/caucus sessions to separate parties, defuse high emotions, and shift the focus from strict legal rights to underlying needs and creative problem-solving.
•Poor Communication & Misunderstandings: Years of unresolved disputes can lead to a total communication breakdown.
•Solution: Mediators encourage structured, active listening and ask clarifying questions to ensure both sides comprehend the opposing perspective

•Lack of Process Understanding & Hesitance: Some parties fear mediation because they perceive it as an "all or nothing" proposition, or lack basic knowledge about mediation services. •Solution: Providing clear, empathetic education on the process—and highlighting that parties maintain ultimate control over the outcome—helps alleviate these unfounded fears.

•Systemic Issues & Power Imbalances: Parties may have unequal access to resources, or attorneys may arrive unprepared.
•Solution: Setting clear pre-mediation strategies and requiring parties to come with proper authority to settle ensures the process remains a faster, more cost-effective alternative.
