Hereโs what to understand:
The Seller Was Not the Legal Owner (on Paper):
Without a title deed, the land was never officially transferred into your name.
In the eyes of the law, the deceased seller still owns the land.
The Land Is Now Part of Their Estate:
Since the seller is deceased, the land becomes part of their estate, and only their legal heirs or administrators (appointed by the court) can officially transfer that land to you.
Your Sale Agreement Is Weak Without a Title:
Even if you have a signed agreement, without registration and a title deed, it's difficult to prove ownership or protect your rightsโespecially if the deceasedโs family disputes it.
What should you do now?

Step 1: Trace the Sellerโs Family or Legal Representative
Find out who the next of kin or administrator of the deceasedโs estate is. Youโll need their cooperation.

Step 2: Ensure Succession Process Has Started
The sellerโs family must go to court and apply for letters of administration (if no will) or probate (if thereโs a will).
This gives them authority to legally handle the deceasedโs property.

Step 3: Request Formal Transfer of Land to You
Once the family has legal authority, they can regularize the sale by transferring the land to your name through the land registry.

Step 4: Start Title Deed Process
If the land has a number but no title, hire a licensed surveyor to confirm the boundaries, prepare a mutation, and guide you through the process of getting the title.
