എന്താണ് ഇലക്ടറൽ ബോണ്ട്? എന്തുകൊണ്ട് ഇത് ഭരണഘടനാ വിരുദ്ധം?

ഇലക്ടറൽ ബോണ്ട് ഭരണഘടനാ വിരുദ്ധമാണെന്ന സുപ്രീം കോടതിയുടെ വിധിയും, രേഖകൾ ഹാജരാക്കുന്നതിനു സ്റ്റേറ്റ് ബാങ്ക് ഓഫ് ഇന്ത്യക്കു നൽകിയ അന്ത്യശാസനയും ഈ പൊതു തിരഞ്ഞെടുപ്പ് കാലത്തു വലിയ ചർച്ചകൾക്കാണ് വഴിവെച്ചിരിക്കുന്നതു.

എസ്.ബി.ഐ ശാഖകളിൽ നിന്ന് കമ്പനികൾക്കും വ്യക്തികൾക്കും വാങ്ങാൻ കഴിയുന്ന പലിശ രഹിത ബെയറർ ബോണ്ടുകൾ ആണ് ഇലക്ടറൽ ബോണ്ടുകൾ. ഇവ 1,000, 10,000, 1 ലക്ഷം, 10 ലക്ഷം, 1 കോടി എന്നിവയുടെ ഗുണിതങ്ങളായാണ് വിൽക്കുന്നത്. ഇത് ആർക്കും വാങ്ങി ഇഷ്ടമുള്ള രാഷ്ട്രീയ പാർട്ടിക്ക് സംഭാവനയായി നൽകാം. ലഭിക്കുന്ന പാർട്ടികൾക്ക് ഒരു കെ.വൈ.സി-കംപ്ലയിൻ്റ് അക്കൗണ്ട് വഴി ഇത് പണം ആക്കാം.

ദാതാവിൻ്റെ പേരും മറ്റ് വിവരങ്ങളും ബോണ്ടിൽ രേഖപ്പെടുത്തിയിട്ടില്ല, അതിനാൽ ഇലക്ടറൽ ബോണ്ടുകൾ ആര് നൽകി എന്ന് തിരിച്ചറിയുക അസാധ്യമാണ്. ലഭിച്ച ബോണ്ടുകളും അവ ആര് തന്നു എന്നും പരസ്യപ്പെടുത്തേണ്ട നിയമ ബാധ്യതയും രാഷ്ട്രീയ പാർട്ടികൾക്കും ഇല്ലാത്തതിനാൽ. ഭരണഘടന ഉറപ്പുനൽകുന്ന പൗരന്റെ അറിയാനുള്ള അവകാശം ഇല്ലാതാകുന്നു എന്നാണ് കോടതിയുടെ കണ്ടെത്തൽ.

2016ലെയും 2017ലെയും ഫിനാൻസ് ബില്ലുവഴിയാണ് വഴി ഇലക്ടറൽ ബോണ്ട് സ്കീം നടപ്പിലാക്കിയത്. ഇതിന്റെ ഭാഗമായി നാല് നിയമങ്ങളിൽ ഭേദഗതികൾ കൊണ്ടുവന്നു. ജനപ്രാതിനിധ്യ നിയമം, 1951, കമ്പനി നിയമം, 2013, ആദായ നികുതി നിയമം, 1961, വിദേശ സംഭാവന നിയന്ത്രണ നിയമം, 2010 (FCRA) എന്നിവയാണവ. ഇവയെല്ലാം സുപ്രിം കോടതി വിധിയോടെ അസാധുവായി.
