The Supreme Court has reaffirmed a major principle on reservation.

In Airport Authority of India v. Sham Krishna B (16 Jan 2026), the Court held that an SC/ST/OBC candidate who scores above the General/Open cut-off, without availing any concession or relaxation, can be selected against an Open/Unreserved post.

🔹 Open/Unreserved ≠ seats reserved only for “General” candidates
🔹 Merit-based reserved candidates are not counted against their reserved quota
🔹 The Court set aside the 2020 Kerala High Court judgment
🔹 The ruling arose from AAI’s Junior Assistant (Fire Service) recruitment

After more than nine years in custody, Vikram @ Manoj’s bail plea reached the Supreme Court, where his two advocate sons made an extraordinary assurance.

They submitted that they were willing to surrender their licences to practise law as a guarantee that their father would not abscond if granted bail.

The matter, Vikram @ Manoj v. State (GNCT of Delhi), Criminal Appeal No. 245/2024, concerns his long-pending bail plea before the Supreme Court.

In Rajneesh Kumar & Ors. v. State of Madhya Pradesh & Ors., Justice Vivek Jain of the Madhya Pradesh High Court dealt with an application under Order ###III CPC to sue as an indigent person.

The Court held that before deciding indigency, the opposite party must be given notice and an opportunity to contest the claim. The matter was therefore remanded for a fresh inquiry.

📚 Key law: Order ###III CPC enables eligible indigent persons to institute suits without paying the prescribed court fee, subject to the statutory inquiry.

The Supreme Court has reduced the mandatory prior legal practice requirement for entry-level Civil Judge recruitment from 3 years to 1 year.

🔹 Until 31 March 2027: Prior practice requirement waived during the transition period.

🔹 From 1 April 2027: 1 year of active legal practice required.

🔹 Selected candidates will undergo 1 year of judicial academy training + 1 year of structured clerkship.
The ruling was delivered by a 2:1 majority on 21 August 2026.

Supreme Court Advocate Balraj Singh Malik sharply criticised the judiciary and government during the CJP protest at Jantar Mantar.

Malik alleged that the Supreme Court and High Courts have failed to adequately protect citizens when those in power misuse authority. He also criticised the government and political parties, raised concerns over freedom of expression and condemned alleged police action against protesters, including women and children.

He further called for protests to extend to the High Courts and Supreme Court.

Lawyers staged a protest outside the Bar Council of India (BCI) headquarters in New Delhi on August 20, demanding the resignation of BCI Chairman Manan Kumar Mishra.

The protest follows the NALSAR enrolment controversy, after the BCI’s directive concerning the 2026 graduating batch was subsequently withdrawn. Protesters have also raised broader concerns regarding BCI accountability and functioning.

The Supreme Court is hearing Bharat Petroleum Corporation Ltd. v. Union of India & Ors. (SLP(C) No. 22411/2026) over a dispute concerning ethanol allocation for ESY 2025–26.

A dedicated ethanol producer challenged its reduced allocation, while BPCL argued that reopening the allocation could affect numerous suppliers and the wider E20 framework.

The Supreme Court has maintained status quo and is examining the dispute involving contractual rights, ethanol allocation and E20 implementation.

The matter reportedly concerned the medium of instruction in a government school, during which the judge is heard remarking:

“Toh kya ab Hindi bhi bachchon ko English mein padhayi jaye?”

The proceedings then took a humorous turn when a petitioner introduced himself as “Pappi Sen”, prompting the judge to respond with a playful remark: “Tum Pappi ho chahe Dappi ho…”
