New research published today should make every Irish solicitor stop and think.
A PhD study of 55 practising solicitors found that only 27% felt they could give comprehensive advice on mediation to clients, despite a legal obligation under the Mediation Act 2017 to do so.

The consequences are real. In 2024, a High Court judge imposed a 5% penalty in recoverable costs on plaintiffs whose solicitors failed to advise them about mediation before commencing proceedings.

The same research found that 94% of clients, when properly advised, favour mediation.

The gap isn't willingness though, it's knowledge.
