Today marks a new chapter for SEND Allies.

When I launched SEND Allies in July 2023, I never imagined I would support a whopping 1,272 clients with either free or paid services over the next 3 years.

I'm currently 20-nil up on the LA's I've faced in tribunals this year.

Most get settled through consent orders because we have the evidence to avoid a hearing.

I'm loving the new proposed case management model though - it really helps to get in front of a judge as soon as possible to help hold some LAs to account for dragging their feet (and ticking down the clock).

Your child's current school might be saying they're "coping", but phase transfer is coming up and you have this gut feeling you can't ignore.

You know what you're seeing at home.

If mainstream isn't working - and you can already sense a phase transfer conversation coming - the evidence you gather now is what strengthens your case later.

Start logging concerns in writing. Ask for observations, not opinions. Keep every email.

These aren't just pet peeves... they're the things that quietly cost families months at tribunal, and children continue to be let down by our education system..

Every one of these is preventable. Every one of these is something I see on repeat.

If you've experienced any of this, you're not being difficult. You're dealing with a system that too often runs on delay rather than duty.

Anything that is in your EHCP must happen... staff absence isn't a reason not to make sure the provision is delivered. I would let it go once / twice, but if your child has 1:1 time, for example, then school must not use that resource to cover for someone else who is out, or not provide it if the usual staff member isn't available.

Keep an eye on this when term starts again!
(if you've informally raised this with school and don't get the situation resolved, then you can complain to the LA to say that Section F provision isn't being delivered... raise it with school first though!)

KE v Lancashire CC (SEN) [2017] UKUT 468 (AAC) and LB Croydon v K-A [2022] UKUT 106 (AAC): both confirm that even substantial cost differences, in Croydon around seventy thousand pounds, are not automatically unreasonable public expenditure.

The tribunal must still examine the facts and the genuine extra benefit to the child before ruling a preferred specialist placement out on cost grounds alone.

When professionals say “they don’t need an EHCP, they’re just naughty”…

Me: enters the chat 💅🩰

Because behaviour is communication, and usually what looks like “naughty” is a child struggling with unmet needs, an unsuitable environment, or barriers to accessing education.

An EHCP isn’t a reward for “good” or "naughty" children - it's there to level the playing field between a child who's struggling and their peers.
It’s there when a child has special educational needs that require provision beyond what’s ordinarily available.

So yes… we’ll bring the SEND law, gather the evidence and fill in the paperwork.
You bring the “they’re just naughty” comments. 😂
