🛡️ Mental Capacity ≠ Unlimited Risk — Carers Still Have the Right to Stay Safe

In our next 3 Sides video, we’re tackling a misconception that causes real confusion in care settings: a person lacking mental capacity does not remove a caregiver’s right to protect themselves or others from harm.

Mental capacity is about someone’s ability to understand, weigh, and communicate decisions. It is not a licence for unsafe behaviour, and it does not mean staff must tolerate harm.

Under UK law — including the Mental Capacity Act and common‑law principles of reasonable force — caregivers can intervene when:

- There is an immediate risk of harm
- A person’s actions could injure themselves or someone else
- All less restrictive options have been exhausted
- Intervention is necessary, proportionate, and time‑limited

Lacking capacity changes how we support someone. It never removes the duty to keep people safe.
