Families Deserve Better – Hold Schools & Councils Accountable

Parents can be fined £80 for taking a child out of school for a term‑time holiday, and if it escalates to court, they can face a £2,500 fine or even 3 months in prison.

Yet schools and councils can leave a child without education for months, even years, with little to no consequence. Children fall through the cracks, families are left fighting alone, and the long‑term damage to their wellbeing, mental health and future opportunities is enormous.

This is not ok. No child should be left without education, and no family should be punished while the system itself faces no accountability.

We’re calling for stronger legal duties, real consequences for failures, and proper compensation for families who have been let down.

Please, please, please share and sign our petition.

The average cost of SEND Provision is upwards of £600 per week, yet families are remedied £900-£2400 per term (on average, this is for 12 weeks) for missed education and SEND provision. Also, this will not apply if you have appeal rights and have an EHCP as the LGSCO cannot investigate this because it will be considered 'intrinsically linked'.

Let's do the maths – children and their families get zero to nothing!!!!!

This is because the current system does not:

- compensate the missed education and SEND provision,

- prevent families from losing employment and then their homes

- encourage improvements to 'service delivery' and, worst of all,

- it does not rectify the long term damage caused to everyone's long-term physical and emotional health and well-being.

This must change now!

We need 100,000 signatures to make this a possibility so every signature pushes us closer to change.

Councils must remember SEND Support is a statutory duty and not an optional extra.

For too long, councils have prioritised funding, Ofsted ratings and professional egos over children’s actual needs. While parents fight daily for basic support, decision-makers focus on budgets, reputational management and internal politics. This isn’t a ‘crisis of demand’, it’s a crisis of leadership, accountability and humanity.

Children deserve provision, not excuses.
Parents deserve honesty and not blame
Councils deserve better accountability.

The Schools White Paper, setting out proposals for SEND reform, has been published today.

Our legal team is carefully analysing the proposals. We’ll share our assessment of how they will affect children's right to provision that meets their needs, and we will post updates here as soon as we can.

We understand this is an unsettling time for families. The most important things to know right now are:

🔸The publication of the Schools White Paper does not immediately change the law.
🔹The SEND legal framework remains unchanged, and all existing legal duties continue to apply in full.
🔸The proposals set out in the White Paper are subject to consultation. We will share further information and guidance on the consultation shortly.
