Browns Independent School - Conceded

Another one of the specialist SpLD provisions. After a significant number of schools were consulted - all of which came back with a no...this one said yes! Conceded before the actual hearing date.

It is amazing how many children diagnosed with SpLD Dyslexia, also have Dyscalculia, Dyspraxia and Dysgraphia.

Dyspraxia is a developmental disorder that begins in childhood and primarily affects coordination and movement. Children with dyspraxia may appear clumsy, have difficulty with fine motor skills like writing or using utensils, and struggle with gross motor skills such as riding a bike or catching a ball. It is a chronic condition that can persist into adulthood, though early intervention can significantly improve outcomes.

Phase Transfer - Moon Hall School Reigate - Dyslexia Win

Another amazing win for this young person.

Time for me to have a little rant - Dyslexia, despite being prevalent in a 10% of the population is still goes undiagnosed and unidentified in so many young people and adults.

4% of these are estimated to have 'severe' dyslexia - how do we know that? We know by the standardised assessment data gathered within their assessments. These young people need specialists. For years I was told 'don't worry' they will get get over it, 'they will grow out of it', 'they will be okay'. Having one indicator of Dyslexia would sit in line with our executive functioning differences, many of this 4% need specialist teaching.

The Dyslexia not only affects their academic attainment, future prospects, it affects their confidence, social skills and can be so severe hinders their ability to access everyday activities that the rest of us take for granted.

So for me this is another win...not against the LA...but a win for the future and independence of this young person!

West Heath Specialist Independent Agreed PT

This appeal was submitted well over a year ago, when the YP was in year 5.

- We had to fight for it to remain in appeal.
- We consolidated 2 appeals
- We resolved sections B and F
- We consulted with 10 other schools
- We fought to keep the AP running in the background
- We had 2 appeal dates adjourned with a final hearing date mid September
- We opened up health and social care
- We ended up with WD V8

It has taken hours of work, back and forth with the working document. Numerous comments. Submission of 2 appeals. Trial days, numerous visits to schools. Countless emails...and now it's done.

Bruen Abbey was agreed today...not just for KS transfer.

We held out as the current placement was causing significant anxiety and today they agreed a June start!

I must admit the Tribunal Officer was one of the easiest I have ever had to work with!

When you are so busy that you have to work on Bank Holiday weekend...at least I had some sun today.

I have been sat in the garden...completing SEND 35a's (refusal to assess), SEND 35's (appealing against B, F and I).

I have amended a WD with the EOTAS plan details in section J!

Typed a SEND 7 to name a school.

I have compared the 2 Independent SEMH schools that have offered a place, to establish how we need to proceed with the one of choice.

Now I am typing questions for the 2 appeals that are fast approaching...to challenge the witnesses!

And all in the sunshine!

HAPPY FRIDAY - LA CONCEDED PLACEMENT

Another positive week! Tribunal Final Hearing was adjourned. The LA was 100% convinced they were going to name 'specialist' as a type. It just so happened the SENDco on our side warned us...so we were ready for the Tribunal Officer. I justified the need for an actual placement to be named.

The Judge was surprised by my determination to argue the LAs decision...but she agreed...

After consulting with out of area placements - Independent Placements - today local authority agreed an out of area placement. Long awaited for this young person and his parents!

The Challenge of Phase Transfer

😢Today for the first time I have come across LAs playing dirty! 🧐Keeping evidence from the Tribunal
🤬Deliberately undermining an appeal
🤥Making excuses the school 'lacks capacity'

I don't agree with LA decisions and speak as I find. I find myself often justifying their process - not because I agree - but because having been a SENDco, I understand the process. This behaviour from an LA is concerning...but in 6 years its the only LA that has behaved like this in one of my appeals.

😭I still have LAs not providing the decision letters and families chasing them
😠They are still not doing Phase Transfer reviews with any integrity
😳P4A is still not being written into plans...this is awful...how are we continuing to fail these young people
😱No professional involvement at AR/PT and no reassessments are taking place

I know we complain about a broken system...but some of these concerns don't need an EP...they just need conscientious SENDco's...we could resolve these things with a little bit of thought.

It's this time of year I feel a little like Dory!

Today's Jobs -
- SEND 7 requesting the Tribunal to add witnesses (the LA have not invited)
- Worked with Mainstream school to observe and add revised witness statement
- Ripped holes in the conduct of the LA
so yes we are now 'Hearing Ready'

- Finished cognitive assessment
- Needs assessment request completed

- Almost have another appeal 'in the bag' think LA are ready to concede

- Spoken to SENDco at Baston House
- Spoken to SENDco at Old Farm

Tomorrow's Jobs
- Got to email EHCP co-ordinator
- Meeting with parent (Draft completed - LA put nothing in we asked for)
- 4 appeals to be submitted

It's that time of year again...Year 5 transition review.

Why? 🤔 I hear you ask 😉

Well when I was a SENDco we always did our reviews in the Autumn term. This was to allow time for the LAs to start looking for schools and consulting for placements.

As the landscape has changed and it has become busier, the LAs are doing them in the summer term before Year 6. This again is done so paperwork can be completed over the summer with a view to consulting in the Autumn term.

This allows plenty of time for the schools to be found before the Year 7 transfer.

This review is important. It is the time to get your EHCP up to date and ready for secondary school.
