The Cameroon Journal of Law, Politics & Human Rights officially publishes its first articles featuring critical legal arguments on pertinent issues in the Cameroon and African socio-legal and political space.
In a brilliant analysis by Ruddy Morfaw (LLD Candidate Centre for Human Rights. University of Pretoria), the author critically examines the question of the right to self-determination and its compatibility with the African Charter on Human and Peoples' Rights, as well as the AU Constitutive Act, on the issue of African State Sovereignty.
The article thoroughly examines two conflicting decisions of the African Commission on Human and Peoples’ Rights (ACHPR - Comm 266/03 & Comm 650/17), all concerning the same state party - Cameroon.
It further proposes that the ACHPR establishes a much clearer and official position on the subject in order to guide potential litigants and the African people at large, on their right to self-determination.
