Not declaring a child in a permanent-residence application is not only a family-sponsorship issue—it may also raise a misrepresentation concern.

IRCC expects applicants to declare all family members, including children who are not accompanying them to Canada. If a child was omitted, an officer may examine whether material information was withheld and whether there are consequences for the parent’s immigration status.

Every case is different. The original PR application, immigration category, timing, reason for the omission, custody situation and supporting records all need careful review.

Do not assume a new application will solve the issue. Obtain a proper assessment before taking your next step.

🇨🇦 OUT OF STATUS versus RESTORATION OF STATUS

These terms are related, but they are not the same.

Out of status means that your temporary resident status has expired, or that you did not comply with the conditions of your permit. For workers, this generally means you must stop working immediately.

Restoration of status is an application that may allow an eligible person to regain their temporary resident status after it was lost.

In most cases, restoration must be submitted within 90 days of losing status. Eligibility depends on the circumstances, including whether you complied with the conditions of your previous permit and whether you continue to meet the requirements for your requested status.

Important: Submitting a restoration application does not normally authorize you to work while waiting. You may only resume work once your status has been restored and a new work permit has been issued, unless a specific exception applies.

Do not wait until the last minute. A proper consultation is necessary to identify the deadline, assess your available options and protect your immigration future.

🇨🇦 Another OINP milestone successfully completed!

We have successfully registered our client’s Expression of Interest under the Ontario Workforce Priority Stream: TEER 0–3. 🎉🎉

Following the employer’s initiation of the job-offer process, our firm was appointed as the client’s authorized representative, and the EOI has now been submitted for consideration.

What happens next?

The EOI will remain in the selection pool. If the client receives an Invitation to Apply, the employer and applicant may proceed with their respective applications within the required deadlines.

Please remember that registering an EOI does not constitute an Invitation to Apply, a nomination, or approval for permanent residence.

Every applicant and employer must satisfy the applicable program requirements. A proper consultation is necessary to assess eligibility and determine the appropriate immigration pathway.

🇨🇦 NEW BRUNSWICK AIP UPDATE | September 14, 2026

New Brunswick has lifted its Accommodation and Food Services sector restriction (NAICS 72) under the Atlantic Immigration Program (AIP). Positions not on the remaining restricted list—including chefs (NOC 62200), cooks (NOC 63200) and bakers (NOC 63202)—may now be considered for endorsement if all program requirements are met.

These eight occupations remain restricted under AIP:

• 14400 — Shippers and receivers
• 60020 — Retail and wholesale trade managers
• 60030 — Restaurant and food service managers
• 62010 — Retail sales supervisors
• 62020 — Food service supervisors
• 64100 — Retail salespersons and visual merchandisers
• 62101 — Retail and wholesale buyers
• 94142 — Fish and seafood plant workers

Residing outside Canada? The reopening does not provide general overseas AIP access for hospitality or food-service applicants. Endorsement applications for positions offered to foreign nationals residing outside Canada remain limited to Government of New Brunswick–led recruitment initiatives in health care, education and construction.

AIP still requires an eligible job offer from a designated employer and compliance with all other program requirements. New employer designation applications remain paused for the rest of 2026. Meeting the requirements does not guarantee that an endorsement application will be selected for processing; New Brunswick considers provincial employment history, economic establishment and ties, and priority-sector employment amid limited allocations.

This change applies to AIP only. Separate restrictions under New Brunswick’s Skilled Worker and Express Entry streams remain in place.

🇨🇦 PARLEZ-VOUS FRANÇAIS?

You may be eligible to work in Canada without your employer obtaining an LMIA through the Francophone Mobility work permit.

You may qualify if you:

• Intend to live and work in a province or territory outside Quebec
• Have a qualifying offer of employment from a Canadian employer
• Demonstrate intermediate French speaking and listening skills—equivalent to NCLC 5 or higher
• Meet the general eligibility requirements for a Canadian work permit

The job offer may generally be under any TEER category, except primary-agriculture occupations under TEER 4 or 5.

Important: An LMIA exemption is not a work-permit exemption. The foreign national must still apply for and receive the appropriate work authorization before beginning employment.

Eligibility depends on the applicant’s immigration status, French-language evidence, job offer, intended work location, admissibility, and the employer’s compliance requirements.

A proper consultation is necessary to assess your complete circumstances and clearly identify your available immigration options.

A positive LMIA allows an employer to support the hiring of a foreign worker, but it is not permission for the worker to begin working.

The worker must still submit the proper work permit application and receive the required authorization before starting employment. Eligibility, admissibility, and supporting documents still matter.

Under a new temporary public policy, eligible foreign nationals with a valid work permit may pursue short-term studies of up to 6 months without applying for a separate study permit.

This can help workers upgrade their skills, complete licensing or training, and prepare for higher-skilled opportunities in Canada.

The measure is in effect until December 31, 2027.
