একই ঘটনায় /অপরাধে দুই বার বিচার করা যাবে না বা দুটি মামলা চলবে না। আমাদের Code of Criminal Procedure এ ৪০৩ ধারায় যাকে Double Jeopardy বলে নিষেধ করা হয়েছে আর CPC তে ধারা ১০ ও ১১ তে রেস সাবজুডাইস ও রেস জুডিকেটা বলে নিষেধ করা হয়েছে। একই বিধান Evidence Act এর ধারা ৪০ এ ও আছে (Previous judgements relevant to bar a second suit or trial). এই একই বিধানটিই সংবিধানের অনুচ্ছেদ ৩৫(২) তে বলা আছে.(No person shall be prosecuted and punished for the same offence more than once).
