The FCFCOA has released a new Practice Direction on the use of Artificial Intelligence (AI) in proceedings.
It is a comprehensive direction that extends well beyond simply checking citations and authorities. It addresses the responsibilities of lawyers, parties, experts and other court users, covering issues such as accuracy, verification, confidentiality, disclosure, expert evidence and accountability for AI-assisted work.
One of the strongest messages emerging from the direction is that AI literacy is no longer optional. As AI becomes increasingly embedded in legal practice, practitioners need to understand both the opportunities and the risks. This includes protecting confidential information, maintaining professional obligations and making informed decisions about how AI can be used to improve efficiency and enhance the client experience.
The reality is that AI is not going away. Used thoughtfully, it has the potential to reduce administrative burden, improve access to information and create better outcomes for both lawyers and clients. Used poorly, it creates significant professional and ethical risks.
At FLENA, we believe education is critical in helping practitioners navigate this evolving landscape. We will be continuing to develop education, resources and practical guidance on AI literacy for family lawyers, as well as enhancing our precedent suite to support responsible and effective AI integration.
