Student Visa refused? The ART review process has changed.

From 1 June 2026, most Student Visa refusal reviews at the Administrative Review Tribunal now proceed “on the papers.” This means the ART may decide your case based on your written submissions and supporting evidence, without an oral hearing.

Your documents now carry even more weight.

Make sure you:
âś… Respond clearly to the refusal reasons
âś… Provide updated enrolment evidence
âś… Keep your Confirmation of Enrolment current
âś… Submit strong written arguments
âś… Act before any ART deadline

Some cases may still proceed with a hearing, especially where serious issues apply, including character, health, security, false information, or special return conditions.

No local experience — can you still get invited? 🤔

Many applicants assume this is a dealbreaker… but that’s not always the case.

Yes — offshore experience can still count towards your migration pathway.

For Skilled Independent (Subclass 189), State Sponsored (Subclass 190), and State Sponsored Regional (Subclass 491) visas, your overseas work experience may contribute to your points score — if it meets the right criteria.

Here’s what matters:
• Your work experience must be closely related to your nominated occupation
• It must meet the relevant migration assessment standards

To be eligible for skilled migration, you must:
• Be between 18 and 45 at the time of invitation
• Submit a valid Expression of Interest (EOI)
• Nominate an occupation on the skilled occupation lists
• Obtain a positive skills assessment
• Meet the points test requirement
• Demonstrate Competent English
• Meet health and character requirements

Additional requirements:
• State Sponsored (Subclass 190) → Requires state nomination
• State Sponsored Regional (Subclass 491) → Requires state nomination or eligible family sponsorship in regional Australia

When it comes to points:
Australian work experience generally attracts higher points, but offshore experience can still strengthen your profile and keep you competitive.

Before you submit your EOI, make sure your points are calculated correctly and supported by evidence.

Employer Sponsored pathways may include:
Employer Sponsored 482 Skills in Demand visa
Employer Sponsored 407 Training visa
Employer Sponsored Regional 494 visa
Employer Sponsored 186 Permanent Residence visa

Eligibility depends on factors including your occupation, work experience, employer requirements, and current migration policy settings.
