Cambie, Chaoulli, and the Impact on Medicare
Tuesday, May 24th, 2022 at 7pm on Zoom (link below)
The Chaoulli case (2005), centered around the prohibition of private duplicative health insurance, was a constitutional challenge originally heard at the Superior Court of Quebec that ultimately ended up in front of the Supreme Court of Canada (SCC). While often compared to Chaoulli, the Cambie case heard in BC’s Supreme Court has far broader implications, with the intent to overturn prohibitions on private duplicative insurance, physician dual practice, and patient extra billing.
Sidrah Laldin, a member of CDM’s Trainee Network at McGill, will moderate, alongside Élise Girouard-Chantal from MQRP. Karen Palmer and Marie-Claude Prémont will provide their expertise on the two cases.
Marie-Claude Prémont is Professor of Law at ENAP (École nationale d’administration publique, part of Université du Québec). She is a member of the Quebec Bar and the Professional Engineers Corporation of Quebec. She does research, writes, and teaches in the fields of Health Law and Municipal Law. She has published numerous papers and book chapters following the 2005 Chaoulli decision by the Supreme Court of Canada, and testified at the request of CDM before the Supreme Court of British Columbia for the Cambie Surgeries case.
Karen Palmer is a health care policy analyst and health system researcher with her passion anchored in equitable access to high quality care. She is an Adjunct Professor at Simon Fraser’s Faculty of Health Sciences in Burnaby, British Columbia, with graduate degrees from the University of Hawaii’s School of Public Health. She has most recently worked with CanCOVID and Women’s College Hospital in Toronto, Canada, (researching hospital funding reform and virtual care); and previously at the World Health Organization in Geneva, Switzerland, where she worked on global TB control. Karen attended most of the Cambie trial, you can read her publishing on it at this link: https://www.frontiersin.org/.../10.../frhs.2021.744105/full
