Tamvir, No. 19-71, offers a few valuable insights into the “No Fly, No Buy” gun control proposal championed by the Obama administration (here and here), House Speaker Nancy Pelosi, failed presidential candidate Hillary Clinton, and Michael Bloomberg’s Everytown group, among others.

The NRA has consistently opposed prohibiting persons from being able to exercise their fundamental rights because of their placement on a secret and notoriously arbitrary government blacklist. Even the American Civil Liberties Union (ACLU), which avoids advocating for Second Amendment rights, objected to the “No Fly” list as a way of regulating access to firearms, pointing to the unconstitutionally vague standards and overall lack of “fundamental safeguards.”

As a case in point, Tanzin v. Tamvir provides a concrete illustration of the many iniquities the use of the “No Fly” watchlist wreaks on innocent people.

The Bureau of Alcohol, Tobacco, Firearms, and Explosives (“ATF”) is publishing the objective factors it considers when evaluating firearms with an attached stabilizing brace to determine whether they are considered firearms under the National Firearms Act (“NFA”) and/or the Gun Control Act (“GCA”). ATF publishes this notice to inform and invite comment from the industry and public on the proposed guidance, Objective Factors for Classifying Weapons with “Stabilizing Braces,” prior to issuing a final document. Upon issuance of final guidance, ATF will provide additional information to aid persons and companies in complying with Federal laws and regulations. This notice also outlines ATF's enforcement priorities regarding persons who, prior to publication of this notice, made or acquired, in good faith, firearms equipped with a stabilized brace. With the COVID-19 pandemic, protests, riots and then the most rabid anti-gun platform ever introduced being pushed by the Democratic party, it’s no wonder that people have increased their demand for guns and ammunition. When a candidate for national office—even a poorly performing one—utters, “Hell yes, we're going to take your AR-15,” what did you think was going to happen?

This is not even attributable to supply-chain problems, with the exception of the Remington ammunition plant in Arkansas. That plant was sidelined by the sale of the company by an Alabama bankruptcy court. Talk about a series of unfortunate events. One of the largest plants in the country couldn’t make ammo at full capacity because of the financial problems of its parent company. The good news is that Vista Outdoor picked up that facility, and the Vista team is very good indeed at making ammunition. I am told after the first of the year, ammunition will be flowing out of that plant, and many of its workers will be rehired.

nraila.org FAIRFAX, Va. - The National Rifle Association’s Institute for Legislative Action (NRA-ILA) has partnered with the New York State Rifle and Pistol Association (NYSRPA) today to ask the Supreme Court to hear a challenge to New York’s restrictive process for issuing concealed carry licenses.

On December 8, 2020, South Portland Police responded to a home on Westbrook Street for a residential burglary complaint. The homeowner reported numerous items of value missing, including several firearms. After the initial report, the case was assigned to the detective division for the follow up investigation.

Incident Synopsis:

On December 8, 2020, South Portland Police responded to a home on Westbrook Street for a residential burglary complaint. The homeowner reported numerous items of value missing, including several firearms. After the initial report, the case was assigned to the detective division for the follow up investigation.

Over the course of the following days, leads were developed that led to a suspect, who happened to be staying nearby. At approximately 2:45 PM on December 15th, a high risk search warrant was conducted at 738 Main Street in South Portland (also known as The Quality Inn). The warrant was executed by the Southern Maine Regional SWAT Team, and turned over to members of the South Portland Police Department for processing. Due to interviews conducted, and items located in the hotel room, 25 year old Ryan BOLES of South Portland, formerly Westbrook, was arrested at the scene. He was charged with Burglary, Theft, and 3 counts of Violating Conditional Release for other pending charges not related to this incident. He was transported to the Cumberland County Jail where he is currently being held on $5,000 bail.

Using information gathered from the first search warrant service, detectives continued to follow up on leads in to the evening and following morning. As a result of the ongoing investigation, at approximately 4:30 PM on December 16th, another high risk warrant was conducted at 857 Main Street in South Portland (also known as The Pine Haven Motel). The SMR SWAT team executed this warrant as well, and turned it over to South Portland Police for processing. Due to interviews conducted on scene and items located during the search, 41 year old Stephen TRACY of South Portland, formerly Saco, was arrested. He was charged with new charges of Burglary and Trafficking in Scheduled Drugs, as well as two outstanding arrest warrants charging Trafficking in Scheduled Drugs from prior incidents. One warrant had been issued by the Maine State Police, the other by Gorham PD. He was transported to the Cumberland County Jail where he is currently being held on $16,000 bail.

Both search warrants were considered high risk due to the nature of the crime committed, the contraband that was expected to be inside of the rooms, and the known criminal history of those parties named in the search warrants. Significant time, care, and planning are invested prior to serving any search warrant within the community. The Southern Maine regional SWAT Team is comprised of members of the South Portland, Scarborough, and Cape Elizabeth Police Departments. They were used in these cases due to their knowledge and training with specialized equipment and tactics, as part of our mission to keep everyone in the community, including our own officers, safe; while continuing our mission to investigate criminal activity. The events of the last two days were a collaborative effort between members of South Portland PD’s Criminal Investigations Department, Community Response Unit, and the SWAT team.

The investigation is ongoing, and will be updated with any future arrests or information. Booking photographs of Boles and Tracy are attached for reference.
