❓ Q&A: Whistleblower Act vs. Official Secrets Act

Q: If I disclose wrongdoing under the Whistleblower Protection Act, am I breaking the Official Secrets Act?

A: No. There is no conflict between the two laws.

- The Whistleblower Protection Act 2025 gives civil servants a safe and legal path to report corruption, abuse of authority, or serious wrongdoing.
- When you disclose in good faith and through the proper channels (like the Anti-Corruption Commission), you are protected from liability and retaliation.
- The Official Secrets Act only applies if information is leaked recklessly, maliciously, or outside the whistleblower framework.

👉 Example:
If you discover that public funds are being misused in your ministry:
- Protected disclosure: You report it to the Anti-Corruption Commissioner under the Whistleblower Protection Act. You are shielded from dismissal or punishment.
- Unprotected leak: You secretly hand documents to outsiders or post them online outside the whistleblower framework. That could breach the Official Secrets Act.

⚖️ Bottom line: Civil servants can disclose wrongdoing under the Whistleblower Protection Act without fear of breaching the Official Secrets Act—so long as they act in good faith and follow the Act’s procedures.

The committee will inquire into the operation of the Corruption, Crime and Misconduct Act 2003 (CCM Act) and consider suggestions for improvement. The committee invites submissions about the CCM Act, and is particularly interested in:

1) The definition of misconduct, including what should constitute serious misconduct and minor misconduct.

2) Who should be included in the definition of public officer.

3) The impact of disclosure restrictions on:

a) witness welfare

b) a witness’s ability to assist police

c) the ability to provide feedback to complainants

4) Measures for ensuring robust investigation of allegations when the Corruption and Crime Commission refers matters back to government agencies and the WA Police Force.
