*ادھار خرید وفروخت میں قیمت کی زیادتی کا حکم*

ادھار پر چیز فروخت کرنے کی صورت میں زیادہ پیسے لینا ربا نہیں ہے، شرط یہ ہے کہ سودے کے وقت یہ طے ہو جائے کہ سودا ادھار ہے اور تاخیر کی صورت میں پیسوں میں بالکل اضافہ نہ کیا جائے۔ یہی سب علما کہتے ہیں، اس بارے میں قرآن یا حدیث یا صحابہ کا قول ہو تو اس کا حوالہ دے دیں۔

جواب
جمہور فقہا کی رائے کے مطابق کسی اثاثے کی خرید و فروخت میں نقد اور ادھار کی قیمتوں میں فرق رکھنا جائز ہے، کیوں کہ ادھار کی صورت میں رقم کی زیادتی صرف وقت کا عوض نہیں ہوتی بلکہ اس اثاثے کی قدر کے بڑھ جانے کی وجہ سے اس اثاثے ہی کا عوض ہوتی ہے، اس لیے ادھار کی صورت میں نقد رقم سے زائد رقم طے کرنا سود نہیں ہے۔ جمہور فقہائے کرام کا یہ اجماع خرید وفروخت کے متعلق قرآن و حدیث میں موجود ہدایات پر مبنی ہے۔ تفصیلی دلائل بمع حوالہ جات کے لیے دار الافتا سے رجوع کیا جاسکتا ہے

ادھار معاملہ کرتے وقت درجہ ذیل شرائط پوری کرنا ضروری ھیں

معاملہ کرتے وقت یہ بات واضح طور پرطے ہوجائے کہ ادھار قیمت پر معاملہ ہورہا ہے یا نقد۔ لہٰذا اگر بائع (بیچنے والے) نے نقد اور ادھار دونوں قیمت بتادئیے، لیکن بائع (بیچنے والے) اور مشتری (خریدار) کے ایک دوسرے سے جدا ہونے سے پہلے اس بات کی تعیین نہ ہو کہ قیمت ادھار ہوگی یا نقدتو پھر یہ معاملہ ناجائز ہوگا۔

(ب)۔۔۔ قیمت کی ادائیگی کا ایک متعین وقت مقرر ہو۔ اگر قیمت کی ادائیگی کا ایک متعین وقت مقرر نہ ہو تو یہ معاملہ فاسد ہوگا۔

(ج)۔۔۔ قیمت مقرر ہونے کے بعداس میں کوئی کمی بیشی نہ ہو،بالخصوص بعد میں مدت میں اضافہ یا تاخیر کی وجہ سے نہ قیمت میں اضافہ ہواور نہ جرمانے کے نام پرزائد رقم وصول کی جائے کہ یہ سود ہے۔

قال ويجوز البيع بثمن حال ومؤجل إذا كان الأجل معلوما لإطلاق قوله تعالى { وأحل الله البيع } وعنه عليه الصلاة والسلام أنه اشترى من يهودي طعاما إلى أجل معلوم ورهنه درعه ولا بد أن يكون الأجل معلوما؛ لأن الجهالة فيه مانعة من التسليم الواجب بالعقد فهذا يطالبه به في قريب المدة وهذايسلمه في بعيدها………..الخ قال: ومن اشترى غلاما بألف درهم نسيئة فباعه بربح مائة ولم يبين فعلم المشتري فإن شاء رده وإن شاء قبل لأن للأجل شبها بالمبيع ألا يرى أنه يزاد في الثمن لأجل الأجل……الخ
