Enforcement and Penalties

By law, security operatives working under contract and all door supervisors must hold and display a valid SIA licence. A non-front line licence is required for those who manage, supervise and/or employ individuals who engage in licensable activity, as long as front line activity is not carried out; this includes directors and partners. The Security Industry Authority is the organisation responsible for regulating the private security industry in the United Kingdom, reporting to the Home Secretary under the terms of the Private Security Industry Act 2001. The SIA's main duties are: the compulsory licensing of individuals undertaking designated activities; and managing the voluntary Approved Contractor Scheme.

Enforcement and Penalties For SIA regulation to be effective and trusted it is vital that action is taken against those who no longer meet our criteria or who break the law.

Security boss deployed unlicensed security guards to luxury development

24 November 2014

A security boss has been sentenced for providing unlicensed security guards to a prestigious housing development in Prestbury, Cheshire.

Gary Ford (42) of Westall Court, Buxton, Derbyshire, pleaded guilty on 11 November to three security offences. On 17 November, Ford was sentenced at Macclesfield Magistrates’ Court to a 12 month community order and a requirement that he completes 300 hours of unpaid work. The court awarded the Security Industry Authority £10,000 in costs, to be paid at £100 a week.

In May 2013, SIA investigators visited the site of two discreet luxury houses in Prestbury, where Ford’s company 4D Security provided private security. SIA investigators found an unlicensed security guard who had been deployed by Ford. SIA investigators again visited the site on 24 November 2013, and found a different unlicensed security guard working on the site. The man was not licensed to conduct manned guarding activities, although he did hold an SIA CCTV licence.

Following the visits to Prestbury, the SIA made requests to 4D Security for information under Section 19 of the Private Security Industry Act. Mr Ford failed to respond.

Nathan Salmon, Investigations Manager said:

“This is a positive result for the SIA, demonstrating that both unlicensed and incorrectly licensed, security operatives cannot be ‘hidden’ at smaller, discreet security sites. Mr Ford’s business model paid scant regard to security regulations, the SIA twice found his operatives unlicensed in the role being undertaken.
“The owners of the houses in Prestbury paid Ford to provide private security. They should have been safe in the knowledge that the people guarding their property were trained, qualified, and held the appropriate SIA licences.
“The court considered the expense in bringing this prosecution, which is borne by correctly licensed operatives, and this has been reflected in the costs awarded to the SIA.”

Just had a call from a student who has been offered employment on a pub door in Glasgows Merchant City. He has been offered "Cash In Hand" he is working without insurance cover, he pays no tax or national insurance. He called for advice.

Our advice is to avoid working for these types of people. It gives reputable companies and the Security Industry a bad name. Imagine something serious happened to him and he got injured and couldn't work? Would these "fly by nights"pay him when not working? Look after him or his family? They would probably deny knowing him as they have a duty of care.

The new business licence being introduced soon, will rid the industry of these types. If you are in doubt, please contact us with the name of the person offering this type of work and we will advise you further.

We have received a few calls recently, regarding Handcuff Training and believe it or not, Baton Training !!!

These courses are not , repeat not, offered by GTS Training. Please think about this carefully.

Why would you pay hard earned cash to be trained to use equipment that you will never be able to use as a security operative or door supervisor ?

Training companies that offer these courses will dress it up any way they can to get you to part with your money, but please tread carefully. We strongly recommend that you avoid this.

Bodycams and SIA Licensing

A headcam/bodycam is a 'hands-free' video recording (and possibly audio recording) device that is worn about the person in order to create a visual record from that person's point of view. This device will usually produce a video feed either to be viewed live by another person in another location, or to be somehow captured and stored for later review.

Individuals who view footage recorded by headcams/bodycams are likely to fall within the definition of public space surveillance (CCTV) activity. If you are employed to use CCTV equipment to monitor the activities of a member of the public in a public or private space, other than for the purposes of protecting property or identifying a trespasser (e.g. if you use CCTV to guard against outbreaks of disorder), and this activity is carried out in connection with any contract for the supply of services, then you will require a Public Space Surveillance (CCTV) licence.*

If you simply wear a headcam or bodycam but do not watch or review any of the footage from that device, the SIA takes the view that this does not fall within the public space surveillance (CCTV) definition. You would therefore not require a Public Space Surveillance (CCTV) licence.

When dealing with matters relating to public space surveillance (CCTV), the Data Protection Act 1998 (and the eight data protection principles that underpin the regulation) must be taken into consideration. Public space surveillance (CCTV) captures information about individuals, and information held by organisations that relates to individuals is covered by the Data Protection Act 1998. Most organisations that process personal data are required to register as a data controller with the Information Commissioner's Office.

*However, if you view footage recorded by headcams/bodycams solely for the purpose of protecting property or identifying a trespasser, then a Security Guard or Door Supervisor licence would be sufficient. Due to licence integration, a Public Space Surveillance (CCTV) licence would also cover you for this activity.

HABC Award in CCTV Operations (Public Space Surveillance) (Scotland) at SCQF Level 6.

Under the Private Security Industry Authority (Act 2001) all individuals wishing to work in the private security industry must undertake a recognised qualification before applying for a licence.

The HABC Award in CCTV Operations (Public Space Surveillance (Scotland) at SCQF Level 6 has been developed to meet the requirements of the Security Industry Authority. It is based on the relevant SIA 'Specifications for Learning and Qualifications for CCTV Control Room Operators (PSS) within Scotland' and provides the necessary skills and knowledge for those who wish to apply for a licence and work as a CCTV Operator.

This qualification comprises of 3 mandatory units:

Unit 1 - Working in the Private Security Industry.
If you have already taken this common module unit, there is no need to repeat it, saving you 1 days training. Proof is required.

Unit 2 - Working as a CCTV Operator.

Unit 3 - Practical operation of CCTV equipment

The qualification can be undertaken by learners aged 16 or over who wish to work as a CCTV Operative. However, an SIA licence cannot be applied for until the age of 18.

The qualification is aimed at learners in Scotland. However, on completion of the qualification, applying for the SIA licence allows for working across the UK.

Successful candidates must achieve a score of at least 18 out of 25

Examination duration - 1 hour

Ongoing practical assessment throughout the course by the specialist tutors.
